Oklahoma Unemployment Eligibility Requirements

Not everyone in the state of Oklahoma is eligible for unemployment benefits. You have to meet a list of criteria to qualify for Oklahoma unemployment benefits and continue receiving weekly benefits.

Monetary Eligibility

To qualify for Oklahoma unemployment benefits, you must meet specific monetary requirements. You must have earned at least $1,500 in the state of Oklahoma during your base period and your wages must total at least 1.5 times the wages you earned during your highest quarter.

In Oklahoma, your base period is the 12-month period composed of the first four out of the last five calendar quarters prior to the date of your unemployment claim. Quarters begin after the first Sunday in each quarter, with 1st quarter being January-March, 2nd quarter being April-June, 3rd quarter being July-September, and 4th quarter being October-December. Your base period is also used to calculate your weekly benefit amount, which you can find using an Oklahoma unemployment calculator.

Non-Monetary Eligibility

In addition to monetary requirements, you must also meet several non-monetary requirements to be eligible for Oklahoma unemployment benefits. Most unemployment eligibility requirements are non-monetary. These criteria mostly focus on how you lost your job and your willingness to work. The reason behind your job separation is usually what stands between you and receiving Oklahoma unemployment compensation.

First, you must be an American citizen or legal resident who is unemployed by no fault of your own (like being laid off). This means you must have quit your former job for good cause, such as unsafe working conditions or a compelling family circumstance.

If you were fired for misconduct, you will not qualify to receive unemployment benefits. Self-employed individuals, contract workers, and gig workers are also not eligible for unemployment benefits in Oklahoma. In order to reach a decision, the state will gather information from both you and your former employer regarding the reason for your dismissal. Once decided, you will be given a written determination on whether your unemployment claim is accepted or not.

You also must be available and willing to work. There are Oklahoma unemployment work search requirements that you must meet in order to qualify and maintain eligibility for unemployment insurance benefits.

Oklahoma requires you to perform at least 2 work search efforts at different employers every week you claim unemployment insurance. You must keep track of your work search efforts in a log provided to you at the back of your Oklahoma unemployment guide. You will also be required to register for work on OKJobMatch.com.

Maintaining Eligibility

After your initial claim is accepted, your eligibility for Oklahoma unemployment benefits is closely tied to your weekly claim. To maintain eligibility and continue receiving unemployment payments, you must file your Oklahoma unemployment weekly claim every week, actively search for work, record your work search efforts, and accept suitable job offers.

You must also keep the Oklahoma Employment Security Commission informed of your employment status. This includes reporting all wages (including commission, cash, or bonuses) the week you earn them, job offer or referral refusals, enrollment in school or training, changes of address or contact information, errors made when filing your claim, or reasons you are unable to look for or accept work. If you are selected for the program, you must also participate in RESEA to maintain your UI eligibility.

Can I quit my job and still get benefits?

In Oklahoma, unemployment benefits are a privilege, not a right. Unemployment insurance is only available to individuals who lost their job through no fault of their own. In order to qualify, an unemployed worker must have been laid off or quit their previous job for “good cause.” The burden of proof falls on you to provide evidence that proves you left your job for one of the reasons that count as “good cause” for quitting.

Reasons you can quit your job for good cause include:

  • Your work situation has become harmful or threatening to your safety, health, or morals
  • You experienced unfair treatment or your employer made working conditions difficult
  • Your employer violated employee rights
  • You were not paid for your work
  • You have compelling family circumstances, such as medical conditions, an immediate family member you must care for, domestic violence, or you quit because you had to move for your spouse’s new job over 50 miles away

Reasons why you may be disqualified:

  • You were fired due to misconduct, wrongdoing, dishonesty, excessive tardiness or absenteeism, violation of Oklahoma law or work policies, or an intentional breach of your job duties
  • You are unwilling or unavailable to actively search for work
  • You refused a suitable job offer or work referral
  • You are not a U.S. citizen or authorized to work in the U.S.
  • You refused to participate in reemployment services
  • You restricted the hours, wages, days, or areas of work you would accept
  • You received bonuses
  • You are self-employed
  • You are a member of a union involved in a strike
  • You are working full time
  • Your gross earnings, severance payments, vacation payments, or bonus payments are $100 more than your Oklahoma weekly benefit amount
  • Your retirement payment is higher than your weekly benefit amount

RESEA

Some claimants, often those who have been collecting unemployment benefits for a while without finding work, are selected to participate in Worker Profiling and Reemployment Services, known as RESEA.

If you are chosen for this program, you must participate or risk losing your benefits. If selected, you will receive a notice to report to your local Oklahoma Works office for the program.

The goal of RESEA is to connect unemployment claimants with suitable work as quickly as possible. You may be required to attend an Oklahoma Works American Job Center Orientation Session to get an overview of the services available to you through the program and create a reemployment plan.

You will be required to register for work on the OKJobMatch website, where you will fill out a resume and connect with employers. After that, you will be given job referrals based on your qualifications, skills, and knowledge. You will need to continue actively searching for work and keep track of your work search efforts. The Oklahoma Employment Security Commission will randomly audit your work search records to make sure you are still looking for work.

During your time in RESEA, you may also participate in Job Search or Job Skill Workshops for training on resume writing, job application and interview skills, social media, and more. Thirty days after receiving employment services, you will have a follow-up meeting to discuss your progress and any barriers to employment you might be experiencing.

Will my employer be notified?

OSEC is required by law to notify your last employer of 15 days or more that you have applied for benefits, and to obtain from them the information needed to process your application. Hence it is important to provide accurate information. If there is a difference in the information cited then you maybe denied benefits. Also note that your employer has the same rights as you if your are found eligible when it comes to appeal. If your employer appeals the decision, the appeal does not stop your benefits. However, if the employer wins the appeal, you will be considered as overpaid for any benefits you received. It is important that you participate in the hearing on the employer’s appeal so you may present your side of the case.

Can I work while receiving benefits?

Yes, you can go ahead and work part-time while receiving benefits but it is very important to declare all your earnings.

Any employment like full-time, part-time, temporary assignments, short term contracts, volunteer work or cash-in hand jobs such as mowing lawns & babysitting must be reported when you are filing for unemployment benefits. You may be entitled to a reduced amount of Unemployment Insurance benefits while you are working. You shall be considered “unemployed” any week that you perform no services and are paid no wages or any week that you work less than full-time and your earnings are less than your weekly benefit amount plus one-hundred dollars ($100.00).
Full-time work is defined as 32 or more hours of work per week. Remember, most “weeks” begin at 12:01 a.m. on Sunday and end at midnight on Saturday.

You must report the amount of money you earned before any deductions were made for each week, whether or not you were paid during the week. Earnings must be reported during the week you earn them, not when you actually receive the payment. Work is anything you do for wages, including self-employment, during the seven days of the week you are claiming Unemployment Insurance benefits.

Will I be eligible to receive benefits if laid off?

The case of lay-off occurs when the company is unable to allot sufficient work to its employees as a matter of many reasons and hence is forced to furlough its workers temporarily or permanently. This is clearly not the mistake of the individual and hence he / she will be eligible for unemployment benefits, provided the monetary eligibility requirements are met. Also, you can avail unemployment benefits if your work hours were reduced and it is less than 32 hours a week.

If Your Oklahoma Unemployment Claim Is Denied

If your Oklahoma unemployment claim is denied but you believe that you are eligible to receive UI benefits, then you still have the right to file an appeal. Your Oklahoma unemployment appeal must be submitted in person, through email, by mail, telephone, or fax within 10 days of receiving your determination notice.

Be sure to include your name, Social Security number, phone number, date of determination, and section of law you wish to appeal, which is found on your determination notice letter. Include a statement that explains why you do not agree with the Oklahoma state government’s decision.

So I work for an employer that has no HR, does not follow OSHA. not Bryan County Health Codes, was served a cease and desist on manufacturing foods, was turned in to Bryan County Health , the Oklahoma FDA, The State EPA. I was told to falsify freshness dates and record them on the food we sell, I questioned this and was told, by the owner, that if I didnt like it, there is the door. SO according to OK unemployment laws, you ask, fired, quit, ect, you leave NO room for situations like this, if I get fired, no unemployment if I quit do to MAJOR OSHA and HEALTH VIOLATIONS, I am screwed, brilliant laws !

If I was suddenly terminated via a text message stating I had 7 days off without PTO, but those days are not outlined nor provided after several requests AND it is l possible that the days are actually while I had been admitted to the hospital and in the ICU for 4 days…. And my claim is pending, it would seem that the employer is likely trying to deny my claim… When in the eligibility process is the claimant contacted to provide information? Or is that not until an actual appeal hearing?

    It genuinely presents as though I was wrongfully terminated as a result of my medical condition… should I pursue?

      Your employer probably knows their rights, however you know when you were admitted to the ICU and presumably have copies of your medical records as proof. I hope you have saved the text message. The Oklahoma Unemployment Office will gather information from you when you apply. If your employer disputes your version of events, they will ask for additional info.

My weekly claim was processed after answering the questionnaire successfully I believe I even reviewed the questionnaire successfully without any issues of accidentally Miss answering any of the questions. However, the statement at the end of submitting my claim made a statement of processing claim your claim has been processed and you will not be made payments available for this week. Now, the description and my eligibility determination reads non-monetary pending on a Sunday, so hopefully tomorrow everything’s reviewed and they send it through, but if not then is there a way to appeal it before they even make the non-monetary determination even though I’ve double and triple checked all of their verification qualifications and eligibility determination questions at a multiple of occasions. Please tell me since they did not have an amount paid on my payment made list whatsoever, then if they approve will I receive my benefits the day of or will I have to wait next week after I claim another?

  5. I received an amended Monetary Determination of Unemployment Benefits letter from OESC on 25 June 20 stating “wages are on file for (name of last company I worked for)”. The letter shows that I have weekly benefit amount and what my benefit year is. It also lists all the companies I worked for and amount paid in 2019. To date I haven’t received any UI benefits and I have been filing each week since 21 Jun 20 (my effective date). I am going to need the money to pay for my mortgage payment this month and my other bills. Please let me know what I need to do to clear up any issues with my unemployment. I already have a Way2Go card and check it weekly for a payment. I do not need to receive the pandemic relief money (the extra $600) if that is the issue as I was working when the pandemic began and because it was a temp to hire and I wasn’t hired, I am filing for regular UIB only.

  9. Since Covid19 I had to resign from my job 3/22/20 I filed my Claim I was approved and have been receiving benefits. 2 times they put a hold o. Them for a few days. 1 was for separation issue, but was cleared the 2nd was for a non monetary issue but was also cleared. Both happened in April. We are now ending June (6/24) and it’s on another hold

  11. I had approved ADA medical leave when my site was shut down. I put on my unemployment application that I had medical restrictions due to degenerative disc, meaning I couldn’t lift much and needed to change positions every couple hours. I was contacted by the unemployment office and asked if I was able and available to work, if I was trained in a field that could accommodate my restrictions, and if I had been released by a doctor. I told them that yes, I was able and could work, had training and years of experiences with call center work, and had not actually been on a restriction, just had ADA leave that ended the last day of my employment. I wanted to ask, will that cause problems in me getting approved for Unemployment?

      • I was released from my job at Amazon in December because they said I was not meeting the numbers which I didn’t know we were working longer days with only one day off tired no sleep in having to watch a new born during that time. I was receiving unemployment up till June it stopped they said I just needed my ID information to prove who I was now that I have provided them with ID information it has been like two weeks everything has been lifted but waiting on Amazon can they deny my unemployment for being let go because of my performance nothing else just performance since I was already getting till about a month ago. Its been like two months now since I received any money they have told me I have about another week left or more I guess it takes 21 days till the time I turned in all my paper work on July 21. I live in claremore and im a over the road driver working for a company out of salt lake city, Utah im on a probation for medical reason for 3 months with no pay for the three months. on the 3rd month once cleared from concentra then i can return to work. Can i claim for unemployment benefits/insurance? For the 3 months i will have to see my dr. And continue blood test until im cleared of the reason i was on the probation

  14. Hello, I was fired just today for a large variance, which I’m not sure how it happened. I scanned all tickets and used the currency counter for large amounts of money, but I was fired for it. I’m just wondering if I can apply for unemployment or would the termination count as being at my fault?

  16. I am a military spouse. My husband received orders to PCS this September. I was not expecting us to be here only less than a year. I’ve been employed at my job for 8 weeks now, but did have a stable job in Texas in 2018. Can I still be eligible for Oklahoma unemployment?

  17. Since starting my current job in November my workload has quadrupled because of other workers having been moved to different departments of the company and another that left for health reasons. Everyday I am given more of a workload and there is no way to complete all of the work. My boss constantly tells me I just need to work longer hours and says that “you’re salary, you can work as much as I want” this is affecting my job performance as I can’t get everything done in time and it has caused me to start to have panic attacks. I’m going to the doctor to see if I can get help but I’d like to know if there is anything I can do as far as unemployment benefits so that I can have time to look for another job.

  20. I am on medical illness and surgery about 3 months. The employer does not allow me to work until full duty (Per doctor I can on lift 20 lbs under treatment and able to perform full duty after surgery)

  21. We left work at 5pm, my boss told me and 4 other guys to clock us out at 7. He does our time. Well company find out about it..and fired him and everyone that has those 2 extra hrs.   23. I worked 20 years plus with this company. The company fired me because I did not meet their performance. Can I eligible for unemployment benefit?

  24. So I work at a convenient store and had recent knee surgery and my store manager asked me if she could get some of my narcotic medication and I told her no. Multiple employees heard the incident and it was reported to vp and hr of the company and they refuse to drug test her and my witnesses haven’t been questioned about the ordeal. They also refuse to drug test her and said any drugs in her system are irrelevant. If they don’t get rid of her and she continues to make remarks like I’m faking my knee issues is there anything I can do? I have all documentation of conversations. Would I be eligible for unemployment? Any info is greatly appreciated

  28. We hired a young lady for an office position. She on her phone a lot. I have spoken to her about this twice and while I was on vacation, my old boss filled in, and she did the same thing. I spoke to her and explained to her this job might not be the right fit for her, we are a very small company 5 employees total, and she seemed to do better for a couple of days, but I just don’t think this is going to work out. She has been here eight weeks. We have a probationary period of 120 days. If we let her go, can she file for unemployment benefits against us this early in the job?

  29. I worked for the state 9 years. Child welfare [Foster Care/Adoption] has changed so much with too much work it is very hard to complete on time without mistakes. Due to medication changes add that on the job stress I made a big mistake. I was told that I could give 2 weeks notice and submit a letter of resignation or be fired. I was on FMLA and my doctor said I was unable to make critical decisions due to type of medication. I worked average 50 hours a week but off to doctor visits frequently. Due I qualify for unemployment insurance? I am 61 years old.

  30. I worked for a company for 14 years and in 2017 came down with labrinthitus and could not drive, tolerate noise, light from computer screen and had difficulty concentrating and reading. I went on FMLA and steadily began to improve and started working part time on my low light iPad from home. My manager assured me everything was okay, saying my job Could be done remotely. This went on for months until 1 day HR called and told me my FMLA was up and in 2 days I was finished working. They gave me the option of either filing for disability and if denied I’d loose my medical insurance or I could retire and keep it. I had to keep my insurance so I was forced to quit. Would I qualify for unemployment?

I worked for a private college that informed us in a meeting on June 28th that the campus where I worked would close its doors in July, and as of the 28th, would not be accepting any new students; we received this same information in writing. We were informed that current students and some employees at that campus, would be transitioned to one of the other two campuses. We were also told that the Executive Director would meet with each one of us regarding our individual situations. I was informed that afternoon, that my position was being eliminated and there was not another position for me to transition into. I applied for UI benefits the week of July 1st. I was informed by UI that there is a pending issue on my claim because I worked for an educational institution. I will not be returning to work for that employer due to the campus closure and lack of work. Will I receive my benefits soon? It’s been two weeks and I’m having a hard time finding another job relative to the one I lost. Thanks!

  33. My husband has worked for a public school system for 23 years. Last week he was sent a letter stating that his job is being eliminated because they are outsourcing the maintenance department effective June 30th. Since he only works monday through thursday his last day was yesterday, June 28th. Does he have to wait until after the 30th to file?

Cops said i do a thing because car was still in his name and we asked cop if we could retrive the deposit and owener said we could look thew car, there was nothing thier. I took owener to court and only received 2000 cars worth with proof of title being notary signed, judge said no proof he took money.   37. Okay here’s my issue. I work for a company that is cotracted by a university. I experience lay offs throughout the year. I have been with the company for 3 years now and just recently I’ve been laid off for the summer. My problem is when I filed my claim this time I was denied because I have a return to work date in which I always have a return to work date when I’m laid off. So I’m wondering if this is a knew law because as I stated I’ve worked for the same company for three years and this has never been an issue.

  40. I am a military spouse (currently stationed at TAFB in OK) and have held my current job for 3 1/2 years. We just received order to WA in August. Can I apply for unemployment for resigning from my job with good cause when we are getting ready to PCS?

  41. I am diabetic, I have been working at a convience store where I’m up on my feet 9 hours a nite 3 days a week. I also have severe diabetic neuropathy in my feet which causes intense burning and pain. I go to doctor each week to get 4-10 shots per foot per week with little relief. Being on my feet causes intense pain, do I qualify for unemployment if I quit my job due to medical reasons

  42. I was terminated (wrongfully) over something I published on facebook, that had nothing to do with my job/company. Am I eligible for unemployment?
    *Side note* However, old co-workers that still work for that company post offensive things about their job/company and still have their job.

      If you can prove you were terminated wrongfully, you can claim UI benefits. Please gather supporting paperwork and consider applying.

  43. I was terminated from my job, but qualified for unemployment, which I am receiving. If I go back to school full time, will that disqualify me from receiving unemployment? What if I’m able and available to work all but the hours I’m in school?

  44. If I give my job 2 weeks notice because my job has caused me headaches and it’s only getting worse, do I qualify? I have documented doctors letters stating that working in my work environment has caused me increased stress and the migraines.

      You can be eligible under such circumstances. Before you decide to resign, please call the Unemployment Office for a discussion.
