Eligibility for unemployment insurance is determined by state law. More than half of jobless workers do not claim unemployment benefits because either they do not qualify or feel the filing process to be very complex. Contrary to this, numerous people meet the criteria for benefits and state unemployment offices have also reduced the amount of necessary paperwork over a period of time. This article will make eligibility criteria clear for filing unemployment benefits.

Basic Eligibility Criteria

Based on your state there may be eligibility requirements for unemployment coverage including having worked for a definite period of time. The Job Service may need job seekers to apply for jobs, submit resumes, and turn down a position if it meets certain standards.

Other Eligibility Factors to determine benefits are:

  • Must be monetary eligible
  • Past earnings activity (labor force attachment)
  • Conditions of job separation
  • Be totally or partially unemployed
  • If you are identified as likely to tire out unemployment benefits and are registered in the worker profiling and reemployment services program, you have to fully participate in all assessment interviews, orientation, and referred reemployment services.

After filing an initial application for Unemployment Insurance benefits, you will obtain a Determination of Unemployment Compensation with facts about your monetary eligibility. The monetary determination is not an assurance of payment. It is to give advice to you and your employer that a claim for benefits has been filed, if qualified, what the weekly benefit rate will be and upon which earnings that rate is based.

Example 1:

Let’s take an example from the state of California. Anyone may file a claim for jobless benefits in California. However, not all those who file will be entitled. In order to be qualified you must first have adequate work and earnings to set up a claim (what’s recognized as Monetary Eligibility). The wages may be from work in California only, in California and another state(s), or from work with the federal government or U.S. military service in any state.

If in doubt, file the claim and allow the Employment Development Department (EDD) make the conclusion. If you cannot establish a valid California claim the EDD will tell you what your options are for getting a valid claim.

California glances at earnings grouped by calendar quarter. A quarter consists of three precise months; January, February, and March from the 1st quarter of the year, and so on. By law, the Employment Unemployment Department can only employ the four quarters that ended before the last quarter to assess earnings. These four earnings are called the Base period of the claim; it is the only period of earnings that can be used to decide present eligibility.

How the Base Period is Determined?

Wages are drawn from a one-year period (four calendar quarters) to compute eligibility. This one-year period is called the Base Period.

If your claim is effective with any Sunday in: January, February, or March - The Base Period will be the first nine months (Jan-Sept) of last year and the last three months (Oct-Dec) of the year before last;

If your claim is effective with any Sunday in: April, May, or June – The Base Period will be all twelve months (Jan-Dec) of last year;

If your claim is effective with any Sunday in: July, August, or September – The Base Period will be the first three months of the current year (Jan-Mar) and the last nine months (Apr-Dec) of the last year;

If your claim is effective with any Sunday in: October, November, or December – The Base Period will be the first six months (Jan-June) of the current year and last six months (Jul- Dec) of the last year.

The quarter you file and the previous quarter (the months in red and white) do NOT count at all toward the Base Period, regardless of how much you earned. Neither does any time before the Base Period, even if you worked for fifty years. Benefits are only depending on the Base Period, which is, in turn, decided by the date you file for benefits.

Example 2:
Let’s consider the earnings requirements in California for example
You can establish a legal claim in two ways in the state of California:

  • Earn no less than $1300 in any one quarter of the Base Period, or
  • Earn no less than $900 in your uppermost quarter of earnings during the Base Period plus in the rest of the Base Period earn no less than 25% of the highest quarter earnings.

For instance, if you received $1000 in your highest quarter, the claim would only be legal if your total earnings all through the other three quarters amounted to $250, for a Base Period total of $1,250:

$1000 + (25% x $1000) = $1250 in total Base Period earnings.

So even though you earned $100,000 in your highest quarter, but did not earn as a minimum $25,000 all through the rest of the Base Period, you would not be qualified! Or if you only earned $899.99 in each quarter, you will fail by one penny. That is the rule.

When you file a claim the EDD will send back you a printed copy of the determination of monetary eligibility. Test out cautiously to settle on if your employer(s) reported your earnings properly. You can constantly request a recomputation if the data appears wrong.

EDD will also offer the following information:

  • The beginning and ending date of the claim
  • Weekly Benefit Amount
  • Maximum Benefit Amount

Weekly Benefit Amount

The sum of money to which a claimant may be entitled each week, based on the claimant’s covered wages paid during the base period.

Let’s consider an example from the state Mississippi:

The maximum Weekly Benefit Amount (WBA) allowed in Mississippi at this time is $235.00. Your WBA for unemployment insurance benefits depends on the total wages in the highest quarter of your Base Period and by dividing that amount by 26. The minimum WBA in Mississippi is $30.00. To estimate your WBA you must first determine what your wages are for the highest quarter during your Base Period.

To be eligible for benefits, you:

  • Must have worked in no less than two quarters of your base period,
  • Must have earned no less than $780.00 in the highest quarter of your base period, and
  • Must have earned 40 times your WBA in your base period.

The highest amount of benefits that can be paid to you during your Benefit Year is 26 times your WBA, or one-third of your total Base Period wages, whichever is the lesser.

If you file a claim for benefits and it is determined that you do not have enough wages in your base period to be eligible, you may reapply again after the quarter changes, if you are still jobless. The quarters used to decide the base period change every three months, on the first Sunday of January, April, July, and October.

Who can be claimed as a dependent?

If you do not meet the criteria for the maximum weekly benefit rate, you may be entitled to a dependency allowance. Dependant’s allowance is additional money added to a claimant’s weekly benefit amount if the claimant supports a dependent.

If you would like to claim a dependency allowance when you file your claim, you will be inquired to give the social security numbers of your dependent children.

Your dependent child or children must fall into one of the following categories:

  • Under 18 years of age.
  • Under 21 years of age and a full-time student.
  • A mentally or physically handicapped child of any age

You are required to give proof of dependency.

While you are receiving benefits, you must inform DUA (Department of Unemployment Assistance) if there is any change in the number of your dependent children or in your status of providing support. In total, 12 states pay dependency allowance.

For Example:

Total dependency allowance for Connecticut cannot be paid for more than five dependents ($75). California does not pay dependency allowances.

When to File for Unemployment?

Filing for unemployment must be the initial item on your plan when you have been laid-off. It might take a few weeks to collect a check, so the quicker you file, the faster you’ll get paid. A delay in filing will mean a wait in collecting unemployment benefits.

How to Claim Your Benefits?

In order to obtain unemployment compensation, workers must meet the unemployment eligibility requirements for wages earned or duration worked during an established (one year) period of time. Besides, workers must be firm to be unemployed through no fault of their own, so if you were fired or quit you may not be qualified for unemployment compensation.

Confirm with your State Unemployment Office for briefing on what benefits you are entitled to. You may be able to file over the phone. In various states, you can file online for unemployment.

In general, to file a claim you will need:

  • Social Security Number
  • Alien Registration Card if you’re not a US citizen
  • Mailing address including zip code
  • Phone number
  • Names, addresses and dates of employment of all your past employers for the last two years

Disqualification from Unemployment

The following conditions may disqualify you from collecting unemployment benefits depending on state law:

  • Quit without good cause
  • Fired for misconduct
  • Resigned because of illness (check on disability benefits)
  • Left to get married
  • Self-employed
  • Caught up in a labor dispute
  • Attending school

Check with the Unemployment Office if you have the above or any other special circumstances.

Frequently Asked Questions For Eligibility Criteria

Can I collect for voluntary termination of a job?

Yes, if the reason for leaving is justifiable and related to work or, in some circumstances, to domestic issues. Check with your state’s employment security office for clarification.

Will I qualify for unemployment if I was allowed to resign but received a severance package?

If you quit or get fired, then you are not eligible. Only hope is that you explain the situation to unemployment office (after you lose the job) and they consider your case under “good cause” provision.

If I start collecting social security does this stop my unemployment?

Unemployment insurance benefits are not counted under the Social Security annual earnings test and therefore do not affect your receipt of Social Security benefits. However, the unemployment benefit amount of an individual may be reduced by the receipt of a pension or other retirement income, including Social Security and Retirement benefits.

You should contact your state unemployment office for information on how your state applies the reduction.

Are elected officials eligible for unemployment compensation when terminated by a different employer?

The law does not allow using some types of wages to establish claims which include working as an elected official. Hence, may not be eligible to claim the benefit.

Can I file a claim if I already lost a week’s pay from my job?

Yes, because most states pay unemployment compensation benefits based on the amount of earnings for a particular week. However, it all depends upon your weekly benefit amount and, possibly, other factors. File the claim and see.

If I was contracted to work through a company and was let go due to loss of work can I file for unemployment?

Periods of self-employment don’t generally qualify for unemployment insurance claiming, as you’re not paying into the system. The other question likely is, do you qualify based upon your earnings from ex-employment other than the self-employment income? Depending on these factors it will be decided whether you are eligible or not.

    I have a job currently in the mortgage business. I was lied to by the 2 loan officers that I assist at the time they offered me to job (1 year ago). They told me they closed 50% more business consistently than they do or ever have. My pay is a base plus bonus, based on the amount of business that they close, so my income is far less than they lead me to believe it would be. I left a job that paid me twice as much as I am currently making to go to this company based on the lies. Aside from leading me to believe that I wold make a certain amount of money, they also said I would have balance and be able to take days off and that has also proven untrue. I have been looking for another job but find that it’s hard to work a 9 hour day and job hunt effectively. I also do not work well with one of the 2 guys that I assist. I ind him to be disrespectful and to push his job and things that he should be doing onto me.

    My question is this- if I quit the job due to insufficient pay, am I eligible to receive unemployment while I look for a new job? Would I need to have a case as far as the 1 loan officer that I conflict with? Ideally I want out of the mortgage business because it is such an awful industry now. The stress is killing me on top of being miserable at my job and not making enough money to make ends meet.

    I have been collecting unemployment benefits for the past 2 months. I have actively been looking for a job and recently was hired b a friend who manages a sandwich shop. At the interview with the owner I was told my application was lost. The two days that I have worked there I have not clocked in or out and have not been given a time card, nor has it even been brought up. I have also not filled out any forms such as I-9 or W-4. My question is if I quit now will I still get my unemployment benefits. Am I even technically an employee?

    im currently a employee at a call center that was recently bought out. Now they cut our wages, we still have the possibility for bonuses, not paying us for our ten min breaks or the time in rest room. they also changed the whole way they give commission so we never know how much were making. we were union before we were bought out but the new company and wont agree to any of the contracts the union have tried to incorporate our union rep quit after there first union meeting i was wondering if i would be accepted for unemployment ive tried call customer support and cant get a straight answer there telling me i would have to quit to see and with a 4 yr old i cant just quit with out knowing it i have a chance. please help thank you

    It is inaccurate to say that a severance package makes you ineligible for benefits. You will not be able to collect for the duration of the severance pay, but in most states you will be eligible after your severance runs out if you have not found employment by then and you still meet the other eligibility criteria.

    I was injured on job and was receiving Workmens Comp. for several weeks and prior to that I had gone to the Employer with complaints regarding the Elderly residents care and incidents which I felt was elderly abuse. I was told I was hired to cook and clean kitchen and that was his problem in other words it was sweep under the carpet. In a world of everyone not wanting to get involved I took a stand and contacted the State of NH ElderlyAffairs, Concord,Nh. They in turned investigated. I got a release to go back to work, which I did. My Doctor released me to returned to work the Monday after Easter Weekend, the owner called me and asked if I could work the Holiday Weedend which I agreed to. However, when I returned to work the following Monday the owner told me to punch out and go home. So much for standing up for the weaker generation! I was also was deniend unemployment benifits????

      you are a independant contractor which does not qualify you for unemployment! You have to be on the books and pay into and your employer has to pay into unemployment in order to recieve benefits

    My best friend was laid off with no notice, no severance. She was told her position was being eliminated due to budget cuts. She had no disciplinary issues and was told it was not performance based.
    However, they have just hired someone new in the exact same role/title she held. Is there a waiting period before they can hire for that same role?

I lost my job because I was medically disqualified for being diagnosed with sleep apnea. Though I’m not allowed to drive, I am able to work other jobs.     Greetings,

    I’ve been on UI for about 10 months now. I’ve had some job interviews, two ‘thank you but no’ letters, other interviews that I never heard from again – but no offers yet. Two things just happened and I need some advice please:

    1) I was given Tier 1 benefits (20 weeks) today Oct 19 2010 but I will need to re-apply Nov 21st 2010 since it will be my one year UI anniversary on that date. The rep said since I have not worked the past year I would not qualify for a renewal of UI. However, the rep said they would therefore continue the Tier 1 payments until that ran out.

    2) An employer called and offered a part time job (15Hr/week) today Oct 19 2010, then later in the day found out I would receive the Tier 1 extension. Do I have to accept the part time job? I’m an electronics tech (AAS degree) and the part time job is janitorial. I could use the time I would be on the job to be looking for work, interviews, etc. Would that be sufficent backgrounds to refuse the job? Thanks for any reply.

    I was denied unemployment benefits and now I’m in the process of appeal. My telephone hearing is set for Nov. 2nd. Basically I told my boss with whom I have worked for,for 2 years that I was in the process of looking for a new job closer to home and that has better benefits for my family. Following after our conversation the next week my hours were cut in half, they took my company truck which I had for over a year, demoted me, and demoted my pay. So I feel I was forced out especially since my family only has one vehicle which my wife uses for work. The job site is 50 miles from my house. I literally had no choice but to quit… Will I win my appeal

    I got a EAD card in 1993 i renew it but when i git a job in 1995 i stop now i file employment because i got laidoff ,and they denied me i’m in process in getting my green card i got a new EAD card i send it to them they said that i were not authorized to work for the earn wages for the years 2008-2009 .

    I HAD WORKED FOR A REMODELING COMPANY FOR TWO YEARS. DUE TO THEIR LACK OF HOURS THEY SAID I COULD FILE UNEMPLOYMENT.     I have a concern, I have worked for walmart for 2 years and 9 month within this two pay periods they have cut hours, I have been workingf full time hours since i have been with the company to find out when hours were cut i was part time when i consulted with human resources within the company its nothing they can do! now i have been cut 20 hours per week .     I was layed off from a federal Govenment job and recieved unemployment
    from The Dictrict of Columbia, until suddenly they stopped due to some finding that I has worked partime in Maryland and they are holding Md responsible for the payments. I have a paper trail of calls and e-mails and had no response and no more unemployment benefits.

    I live in Maryland I found a part-time job with HOme Depot and was just layed off, I opened a new claim with Md Unemplyment, yet they have not included my DC fed Government as an employer. Help please!
    shouln’t Maryland have access to this information?

    Can I recieve retropayments due to me from the time in which Dc stopped paying, and hwo can Maryland help me to solve this matter.

    I was out of work on short term disability from an operation. I was out from April 01- Dec 1. I’ve been with my compnay since 1986. When I found out I was returning to work, my managerial position was taken away, I was transfered to another store and knocked down to part time from my full time position. With an average of 22-24 hours, am I eligible for the unemployment has to offer?

      yes you are eligible, you may recieve full or partial it depends on your wages prior and what your earning now, but you were separated due to no fault of your own, as long as you have all your documentation from your doctor

    I currently work approximatly 40 miles from my home. My job site is being moved permantely 40 miles further away making a total of 80 miles one way. Would this qualify my for unemployment if I quit due to hardship? They have not offered me any compensation for the move and it will cost me over 150$ a week in gas not to mention the 4hrs a day on the road.

    I was employed in a private pre-school for a year. While they did “suggest” that there was a classroom available (which I didn’t express interest in), they failed to give me a new written contract for employment for the next school year. They forced me to write a letter saying I declined the verbal offer. I filed for unemployment and won, but my old employer is contesting it. My hearing is next week. What do you think?

    My son worked part time in Pennsylvania while in high school making only 1,500 a quarter. After he graduated, he got a full time job as a laborer for a masonry company (at the end of September) making $16 an hour so he quit his part time job. Now that it’s so very cold out, they are not able to work. He filed for unemployment but they are going to pay him based off his part time job because that’s how they figure the base period. Is there any way for him to collect on his full time job instead of his part time one?

    does anybody know what elese i can do with unemployment..here is my problem.i was a truck driver in ga..lived in fl and then moved to maryland cause my handicapt son was going to be homeless due to his dad lost everything and had to move california i moved up north and within 3weeks had . 2 jobs. one is a school bus driver and im able to collect some unemployment from ga from the bus job but when i filed they denied me due to they said i quit my job and didnt have a valid work connected reason.the company i worked for doesnt come up here so i would of have to put my son on the truck with me and drove 850miles one way to go to work…im filing an appeal but does anybody have any advice…would appreciate any guidance…

  41. Folks have to be persistent with their claims since the preliminary process is intended to discourage the masses from depleting state funds. Be sure to read through the relevant unemployment laws and state those laws as the basis for your appeal. Keep it organized and uncluttered citing the list of facts, relevant discussion, laws that apply, and your summary that spells out very clearly why you believe that you are in fact entitled to benefits.*

    They may also be looking to see that you exhausted all reasonable alternatives to rectify the situation. Look at it from their point of view to put together your best possible defense.*

    I live and worke in Marylnad. Today I found out that my company is closing in a next month. In this regard, I plan to move to Virginia to live with my parents. Where should I apply for unemployment? Where will I live or where I worked? And if I file in Virginia, I’ll be getting Maryland or Virginia unemployment?

    I was a tipped employee for over two years with my last employment. With no warning my shifts were dropped from 5/6 shifts to 2 shifts a week. And sometimes I would only be given 1 or none at all. The brand new employees get at least 3 shifts a week! I was told that I am not receiving any customer comments through corporate and that is why my hours have been reduced. Isn’t that a form of being fired when management will not allow you to work what is needed to afford your responsibilities? I bust my hump trying to regain my shifts back but I began to feel that they just wanted me gone. In the end, I had a job but it was like I really did not have one. They would of kept doing what they were doing to me for as long as they could probably to keep from officially firing me, in turn, giving me the eligibility for unemployment. Is that legal?

    I was wondering if it is possible for me to get unemployment again. I was laid off for 18 months and returned to work in Sept. of 2010 I am asked to take another lay off for about 2-6 weeks and wonder if I can get unemployment again or if I have to wait longer. I would really like to know as soon as possible for we have until Friday Feb. 4th to let them know.

    I have been working for a coffee company for the last eight years 2 and half of those years I was an assistant manager…the manager thinks that I’m not meeting expectations for this position..therfore he told our district manager..anway we had ameeting and he said that if I would consider dropping down a postion as a shift supervisor I declined the position and I was put on a 30 day action plan and if I don’t meet expectation within those 30 days I’m fired do I have to right to decline the position and qualify for unemployment or if I decline the position can he then say that I resigned ?on as a shift supervisor which
