How to qualify for Arkansas unemployment benefits

To qualify for Arkansas unemployment benefits you must:

  • Meet monetary and work history requirements
  • Have lost your job through no fault of your own
  • Be physically able to work
  • Be available to work
  • Be actively looking for a new job
  • Be a United States citizen or be legally authorized to work in Arkansas

Some Arkansas UI eligibility requirements are monetary, and based on your financial work history and wages. There are also several non-monetary requirements to meet, including the reason you became unemployed.

There are also several ongoing eligibility requirements that you must meet each week before you can collect payment. When you apply for Arkansas unemployment compensation, the DWS will determine your eligibility and the amount of benefits you can receive, called the weekly benefit amount. You will need to file a weekly claim to certify your eligibility for compensation.

Monetary Eligibility Requirements

To be eligible, you must have earned wages from a job in Arkansas where your employer paid unemployment insurance taxes during at least two quarters within your base period. Your total wages during the base period must be at least 35 times your weekly benefit amount.

What is a base period?

Unemployment benefits are not determined by your financial need but are based on how much you were paid by your employer during a 12-month period called the base period.

The more money you earned during this time, the higher your weekly benefit amount will be, up to the maximum weekly benefit amount allowed.

In Arkansas, the minimum benefit is $81, and the maximum benefit amount anyone can receive is $451 for up to 16 weeks (unless there is a UI benefits extension). You can estimate your weekly payments using the Arkansas unemployment calculator.

Alternate Base Period

If you don’t qualify for the traditional base period, there is also an alternate base period that can be used to determine your eligibility. The alternate base period includes the four completed calendar quarters immediately before the quarter when you file your initial claim. It’s meant to help those who have been unemployed for a longer period, recently returned to work (within the last two quarters), but are now unemployed again.

Non-Monetary Eligibility Requirements

In addition to your work history, the Arkansas Division of Workforce Services requires you to be able to work, be available for work, and be searching for work.

Able to Work

Being “able to work” means that you’re physically and mentally capable of performing tasks similar to your previous job or other work you have the experience and training to do. This also means that you have a reasonable chance of finding a job in your field.

Availability for Work

To be considered “available for work,” you need to be ready to accept a job right away. There shouldn’t be any personal or other circumstances preventing you from taking on suitable work if offered.

Reasonable Effort to Find Work

Making a “reasonable effort to find work” involves actively seeking employment by contacting people in charge of hiring, your local union, or other relevant organizations. It means doing everything reasonably possible in your occupation to secure a job as quickly as you can. Your efforts should be focused on finding suitable work that matches your skills and experience.

Do I have to accept any job offer?

When you’re searching for a job while receiving unemployment benefits, you must be willing to accept suitable work when it’s offered to you. The meaning of “suitable work” depends on various factors, such as the pay in the new job, how long you’ve been unemployed, and your earnings at your last job. The law doesn’t require that the pay in your new job be the same as your previous employment.

Unemployed through no fault of your own

One of the biggest factors when determining UI eligibility is job separation – the reason why you became unemployed.

To qualify for unemployment benefits, your unemployment must not be due to any fault of your own. Acceptable reasons for job separation include being laid off because of a lack of work, company downsizing, or business closure. In these cases, you would likely be eligible for unemployment compensation as long as you meet the other requirements.

But if you left your job voluntarily without a good cause, or if you were fired for misconduct, you might not be eligible for UI benefits.

Quitting for “good cause”

Quitting a job with “good cause” means leaving your employment due to circumstances that a reasonable person would find intolerable or unacceptable. Some reasons for quitting with good cause may include unsafe working conditions, harassment or discrimination, or a hostile work environment. You can also remain eligible for unemployment if you have to quit your job because your spouse is relocating for work or military service.

Your reason for job separation plays a significant role in determining your eligibility for unemployment benefits. It’s important to provide accurate information and be honest, or your benefits could be denied. Intentionally lying on a claim is Arkansas unemployment fraud which results in penalties and possible criminal charges.

Ongoing Eligibility Requirements

To remain eligible for Arkansas unemployment insurance benefits, you must certify your ongoing eligibility by filing a weekly claim. You can’t receive your weekly payment until you complete this step each week.

You must verify that you are:

  • Unemployed through no fault of your own
  • Physically able to work
  • Available to work
  • Actively searching for work

During the certification process, you will be asked if you earned any income for the week. You will be asked if you have refused any job offers or job referrals.

Filing Your Weekly Claim

Each week, you need to file a claim to show that you’re still unemployed and actively seeking work. You can file your claim online or over the phone. This step is crucial for continuing to receive your benefits. Learn more about filing a weekly claim.

Waiting Week

After filing an initial claim, you must also go through a one-week waiting period before receiving your unemployment compensation. This waiting week must be a valid week of unemployment, which means that you earned less than 140% of your weekly benefit amount, and met all additional eligibility requirements.

Claim audits

The Arkansas Division of Workforce Services conducts regular reviews of unemployment claims to ensure the accurate payment of benefits. If your claim is chosen for review, you’ll be notified, and certain information will be requested from you.

Job Contact Records

For example, if you’re required to maintain a written record of your work search requirements, DWS may ask you to provide your record of job contacts for the week. The employers listed in your record will be contacted for verification. You can use the Job Contacts Log to track your contacts.

Verification of Earnings

Additionally, any employers you may have worked for while receiving unemployment benefits will be contacted to verify the earnings you reported. It’s essential to keep accurate records of your job search efforts and report your earnings honestly to avoid any issues with your unemployment compensation.

By staying organized and maintaining accurate records, you can ensure a smooth review process and continue to receive the support you need during your job search.

What if I’m denied Arkansas unemployment benefits?

If you are denied benefits or disagree with an ADWS determination, you have the right to file an appeal. You must contact the Arkansas Appeal Tribunal within 20 days of receiving your notice. Learn more about the appeal process.

  2. I quit my job because I am satrting college classes on monday, 3 hours a day, 4 days a week. Where I was working wouldn’t work around my hours. I am looking for full time with someone who will work with my hours. Having trouble finding anyone. Can I get unemployment? My school hours are 12:30pm-3:30 so I can work mornings til 12 or evenings starting at 4. And all day friday, saturday and sunday.

I have two autistic brothers that I care for.   4. I was just terminated from a medical office for discussing wages. I just moved here 9 months ago from Oregon 1. I thought it was illegal and against federal law to fire someone for discussing wages 2. I don’t know if I am eligible for unemployment not living here a year. Can you help

    • Hi, Angie – your right to discuss salary on your own time is protected by a 2014 Presidential Executive Order, along with the National Labor Relations Act. And being eligible for unemployment benefits has more to do with what you’ve earned through previous employment than where you live.   5. I am an Office Manager in a medical practice. We have an employee that can be rude to our owner. She routinely rolls her eyes and has been told that is not appropriate. Recently, when asked if she was okay, she fired back at the owner shouting at her. Her request to use PTO hours to leave early had been denied because she was in the negative, due to medical illness & doctors appointments. Because she was angry over this, she felt it was okay to yell at the doctor in front of another staff member. If she is fired, can she draw unemployment?

    • Hi, Lisa – in general, unemployment insurance supports employees who lose their jobs through no fault of their own – for example, in a layoff or as part of a reduction in force. That doesn’t sound like the situation here. To be extra cautious, it would be wise to run the situation by your legal counsel, including all documentation of the employee’s behavior, any coaching or counseling the employee has received around accountability and expectations and documentation of absences. Then you can be sure you’re moving forward in the best way.

  6. I have worked at a restaurant for a country club as a server/bartender For almost 3 months and my Fiancée has been the head chef for the same amount of time. He has never missed a day of work and was Working at least 12 hour days due to short staff. Almost a week ago he was fired for missing 4 hours of work in order to attend our sons 2nd birthday and when I went into work they had replaced me because the general manager said He assumed I wasn’t coming back because he fired my fiancée (I have proof of him saying he assumed I wasn’t coming back) and even after all of the discrimination and backlash towards me just because he got fired I begged and pleaded to still be able to work what I was scheduled to work and so on. He finally said that I could work but has been very rude with comments saying,”if you’re going to be even 1 minute don’t bother coming back at all”. I had every intention to still work he just assumed I wouldn’t come back and never even bothered to tell me until I got there and was told I couldn’t work and that the “bar manager”(she really just has keys to lock the doors at night and makes the schedule but doesn’t have an actual manager title) would “try their best” to fit me in there somewhere but that they’ve already hired 2 new people. I was wondering how long you have to be working for a company to get unemployment? I didn’t quit nor did I have any intentions to quit, it was all just assumptions because he fired my fiancée and I have proof of him saying that and they didn’t even try to contact me at all to tell me they took me off of the schedule because they figured I wouldn’t come back. I would’ve called them if that was the case. They finally gave me one shift that I’ll be working in a few days but there’s a lot of ruthlessness and just treating me like I’m worthless all because of my fiancée getting fired and him getting fired has nothing to do with me or my ability to do my job and it’s only been a day and a half and all of it was said through texts. I haven’t worked my shift that they said I could work yet because it’s in a few days but now they’re treating me horribly and its being portrayed as if they’re basically just going to use me when they need me.   7. My employer is changing their entire work schedule. I will end up with different hours on a different shift for substantially less money. I’ve already decided to find employment elsewhere. I wonder what my chances are at a hardship case? (state of Arkansas)

    • Danny – you may want to check in with the Arkansas Division of Workforce Services to make sure, but in general you need to have lost employment through no fault of your own and actively be looking for another job in order to be eligible for unemployment benefits. If work was offered to you and you turned it down, that can certainly lessen your chances of being approved.

  9. Starting in a few weeks, my kids will need to be dropped off to care later than my start time at work (I work remote, but my kids care center will be opening a half hour after my start time). My boss will not adjust my hours. If i quit due to the hardship this is causing, will it be considered good cause?

      Unfortunately, there is no way to answer your question with 100% certainty, however, you should:

      –Document in writing (email or text) your boss’s response to your request for 1/2 hour later start time
      –Document the change it Care Center hours

      Your first obligation is to care for your child, and officially unemployment offices (including my homestate, AR) acknowledge that caring for someone else–including a child–is good cause.

      Your chances of getting unemployment benefits are excellent. Sorry to hear your boss is so inflexible.

  10. I am a customer service rep for a bank. I started in August 2021 and was in training for 7 weeks. I was in one department for roughly 3 months before moving to a different department. I’ve with in this 2nd department 2 months. Customer service is important, right? Well, there telling me that if I can’t get my call time down, there gonna late go. Would I be able to get unemployment? In ar, btw.

      In AR, you must have worked to have coverage for 2 quarters of your base period. Since you’ve been employed there nearly 7 months (including training) you should qualify if they fire you. I quote from another page on our site: <>

People keep quitting and they keep giving me more and more things to do with no raise and without replacing the people that quit the other jobs. I’m constantly stressed and I find it hard to keep up.   12. I’ve withstood a very stressful and what feels like a hostile work environment. 12 weeks ago the sales manager of the sign shop I worked at quit and took another job. The owner and sales manager brought me in and offer I take their jobs over and will get to earn commission; I have just been the receptionist for the last year and 4 months. I trusted them and agreed to try it out. The training before the manager left was scarce due to their child being sick, but we stayed in touch after so I could finish their sales projects (about 25 projects, some of which with price tags over $30,000!). The stress of these projects is immeasurable and the support since the manager left is ridiculous. The owner let that manager run the business and knows nothing of how to help me in my role. When Ive gone into her office crying or trying to express how I need help or how I feel, she stiffens up and has said things like “You just need to be in control, don’t you” or “I’m not sure what the problem is or what you want me to do.” Furthermore, I can’t go back to my old role in the store because they’ve hired a new receptionist! Today, she yelled at me in front of the new receptionist and called me “combative”… I have started therapy and am looking at other health insurance options bc the business doesn’t carry EAP and I feel completely in distress. I have at least 3 panic attacks a week now while at work and have to walk around. It’s just too much. I want to quit and I think that’s what the owner wants too, but will don’t feel prepared or in the right state to interview for another job immediately. Can I draw unemployment?

  13. i have been off for 5 months on a medical leave of absence.my dr has determined i cant hsve a sirgery i need at t this time due to a different medical condition diagnosed while on leave.my dr has determined i can return to work with restrictions caused by the original diagnosisbut my employer says i cant come back with any restrictions..will i be able to collect unempkoyment in arkansas?

  14. My employer is requiring that all employees take the covid vaccine as a requirement for remaining employed. I, and others, refuse to take the vaccine so we are being put on permanent leave of absence rather than being fired. Can we collect unemployment benefits while on forced leave of absence?

I am considering quitting my job due to mental health, i’m a veteran with ptsd and because of my work schedule I am not able to attend counseling as needed and because of the meds I take don’t allow me to operate heavy machinery, I am not able to take my meds on days that I have to work and i’m not able to take my sleep meds if I have an appointment and work on the same day because I usually sleep over into my work hours ( I work 12 hours shifts).   18. I was sent home from work in October for 14 days due to possible Covid exposure in Arkansas. I received unemployment because my hours were cut by my employer. Later Arkansas opened an investigation because the reason they had was that I quit due to medical reasons, even though I was allowed to return to work after 14 days. Now mother-in-law broke her hip and with admittance to hospital received a positive Covid test, thus my employer has sent me home for 10 days saying it is an unpaid leave. My question is how in the heck can I apply for unemployment when the only “leaves” to pick from are medical or FMLA? And those are NOT the reason work gave me….and the only other option is the local office….while I’m quarantined???? The state office is literally impossible to get through to…….???

  25. I have an 11 month old and found out I was pregnant againwhen she was 7 months old. I have been with my company for nearly 8 years, never using excessive PTO. My child had been very sick the last 3 months with flu, rsv (typical winter bugs) so I have had to take unscheduled, but approved PTO as daycare will not take her with fever. I have dr notes for documentation of days out. A month ago I went to an OBGYN appointment to find out I had miscarried in my second trimester and was scheduled for a d&c the next day. I took a total of 3 days (approved bereavement) for the day of the loss, the surgery and a day of recovery. Two weeks later my boss called me into her office to tell me I had used my allotted amount of PTO for the quarter and that I would need to resign or be terminated. I put in my 2 week notice the following day to ensure I got 2 full weeks pay and be eligible for rehire. Would I be eligible for Unemployment benefits with a forced resignation?

  26. I’m hoping you can help me out. The situation I find myself in is not were I ever thought I would be. My husband and I both were working for a company based out of Florida. We were sent to Arkansas around the 1st of November to run a jobsite for them. We used a company truck with GPS and they kept track of our time through a ADP app on our phone. If you know anything about the ADP app you most be within 1 mile of jobsite to be able to clock in. On 2/ 26/19. We were notified we were both fired. They claimed that our ADP and our GPS did not match up. I pleaded with that there had to be some mistake. Our Apartment were we were staying was over 10 miles away. We literally had no phone service there. Couldn’t clock in or out if we wanted to. I pleaded for them to have someone look at the GPS to make sure it was working properly. They couldn’t have cared less. They ended up leaving us stranded in Arkansas. Come to find out the day we were fired an investigator showed up at our jobsite. They did not have a license or permit to be working in Little Rock. They had just received one that day. So for months they did not have it. I believe this is the real reason we were fired. They did not want us talking to the investigator. I look for them to give us a problem when we file for unemployment. How can we prove this or is there nothing to be done. Thanks.

      I can understand how much of an ordeal this must have been! Firstly, UI benefits are only extended to claimants who’re on permanent rolls of the company. Contractors do not generally qualify.   35. I was terminated from my position for “job abandonment”. But the issue was I was arrested and detained for 3 weeks over a charge that was dropped as soon as I got to see a judge. My employer was aware of the predicament via conversations with my family members. However, when I was released my employer told me because they couldn’t hold my position due to my own legal matters, I was considered a no call/no show and therefor terminated and unable to be rehired. They’ve told me repeatedly there’s nothing they could do because HR had their hands tied. I have been released now for over 2 weeks which makes a total of 5 weeks unemployed.

  36. I found out I was pregnant in Jan. 2018. I told my employers in March 2018. Since then they have consistently been giving me problems. They harass my fiance and fiances boss if I do not answer the phone when they call. They call me numerous times often to come to work and if I do not come in if they want me to they lash out. It seems like they have been trying to come up with ways to either fire me or get me to quit. A few weeks ago one boss told me my schedule changed so I did not show up for the shift the next morning I had a call and a message from my other boss asking why I was a no call no show. Thankfully I still had all the text or I would of lost my job. Ever since I found out I was pregnant they nit pick all the time. They just recently told me that if I can not come in when they call me on my scheduled days off they are going to find someone else. I have had to go to the hospital due to all the stress they put on me and causing high blood pressure. I never had these issues until I found out I was pregnant. They have told people they are going to fire me. They refuse to give me more than 2 days a week of work. I have told them numerous times I need more than that and they will not. They say they only give me 2 days so I can come in if they need me. I was not hired for an as needed position. I have been looking for another job for a while now but I have had no luck. I have worked here 9 months. I do not want to quit, but they keep finding reasons to either try and fire me or make it look like I just did not show up. Would I qualify for any of these reasons? Just until I can find another job.

      Hope things get better for you soon. Please keep supporting documents/facts handy if your employer decides to dispute. Also, speak the Unemployment Office to ascertain eligibility.

  37. My wife is getting transferred to a different city. I have asked my employer to transfer me to that city but they cannot. if i quit due to my wife’s transfer do i qualify for unemployment benefits

As of 01/02/2018 my government contract switched hands… and the pay cut was pretty substantial at almost half what we were making with the previous company…. the title of our position was pretty much demoted… After working for over a month with the new company, along with several others, we are very unhappy and there looks to be no change…. Is there any chance under these circumstances that we would qualify for unemployment?

      I can understand your situation. However, UI benefits are only extended to those who lose employment due to involuntary reasons. Please call the Unemployment Office.

  40. My husband is a delivery driver and has developed major back pain associated with sitting for hours. We are seeing specialists and he has been out of work for a week already. He will not be able to go back to his job because the pain is unbearable. Will he be eligible for unemployment benefits? He has been at his job for 2 years and was at his previous job for 10.

  41. I am a employer ,i pay cash and give to my employees 1099 form , i pay my business taxes the end of the year, can they take unemployment if the job is slow an they quit?and look for another job

  43. I was let go on my job because I had to have a full hip replacement. They called me and said that they could no longer hold my position . This was in April 29th 2017. My last day with them was Nov 26th 2916. I have been on shorticulture term disability up till June 6th. I am now going to long termine Timmy July 21st. If I am fully recovered I can ask for my job back. My question is if they do not hire me back can I collect unemployment till I find a new job ?

  44. I had gone through the proper channels, my Director and HR which only made matters worse for me. After being forced to go higher with my concerns, “THEY” made an official complaint of harassment and retaliation against my Director on my behalf. I was not the only person receiving this treatment in the facility. It was and still is very common knowledge throughout the facility. They performed an 8 hour investigation, not talking to anyone other than My manager and director before they closed the complaint with “no findings to support “my” claims.” I was transferred to another department, in a another location of the facility, but the harassment continued from the first day of the transfer. I submitted my resignation citing that “I was no longer able to work in such a hostile environment and that the change of location had done nothing to reduce those levels of hostility.” I left in what I thought was good standings (trying to avoid their history of “black-listing” those who quit or get fired)with a 6 week notice and even trained my replacement. I even continue to answer phone calls to help them figure out how to handle situations. I have applied for so many positions that I am perfectly qualified for over the last 2 months, and gotten not one single offer (not even a single reference check). This company has a huge reputation for “black-listing” people who leave, but are extremely careful in covering their tracks. This is a small town and all HR departments are friends. I have tried to not make it known why I left, siting that the job that was once done by 3 people, I could no longer keep up with and have any time at night to study. Which is also true. If I go to apply for unemployment benefits, will the reason I resigned be made public for possible future employers to see or become aware of?

      You don’t have to be too concerned about UI benefits. Please apply and make sure to keep supporting documents handy in case of a dispute by your employer. I don’t think there is any purpose in “releasing” the information. You can call the Unemployment Office in your state for further consultation.
