Can I be paid for my dependents?

A dependent is defined as a son, daughter, stepson, stepdaughter, or legally adopted child (not grandchild or foster child) under 16 years of age for which you provide support.

You may be eligible for dependents’ allowance of $8 per dependent for up to 5 dependent children. Dependents’ allowance will only be paid for 26 weeks during any one-year period. Only one parent may claim a dependent during any one-year period. The maximum weekly benefit amount, including any dependents’ allowance is at present $430 per week. Calculate your benefit amount.

What if I am working full time but earning less than my weekly benefit amount (WBA)?

If you are working full-time but earning wages that are less than your weekly benefit amount (WBA), you are not unemployed as defined by the Maryland Unemployment Insurance law. As a result, you are not allowed for either total or partial unemployment insurance benefits. Therefore, it is your job to tell DUI staff that you are a full-time worker. Failure to disclose this fact may be viewed as an effort to falsely receive unemployment benefits.

Are unemployment insurance payments taxable?

Yes. Any unemployment insurance benefits that you collect must be reported as part of your gross income for both state and federal tax purposes.

To help you in filing your tax returns, there is an IRS Form 1099-G showing the total amount of unemployment insurance benefits paid to you during the previous year. You may choose to have taxes deducted from unemployment insurance payments. You can decide to have either Federal taxes, Maryland state taxes, both or neither deducted from your payment. You must sign and return the W-4 form before any taxes can be withdrawn from your unemployment insurance benefits.

  2. My husband has to have surgery on his foot, and is expected to be out of work for at least two weeks. He has been employed with the same company for over 5 years. Would he be eligible for unemployment benefits?

    • Kathy,

      UI benefits are extended to claimants who’re able and available for work. If the medical condition is due to work environment, he might be eligible to claim benefits under Workers Comp.

  3. I was let go of my job due to a disability and may be receiving short-term disability payments from my previous employer (I am waiting to hear back from the disability company). I am currently not well and cannot work. Do I still file an unemployment claim? If I do that, is there a place where I can say that I am currently unable to work?

      Please note Unemployment Insurance benefits are available only to those who’re able to and available for work.

  4. I worked part time 20hr/week for just over one year. My mom who was 96 fell ill and went into home hospice and I had to care for her. I tried to keep my job, but was unable. We just “Parted ways”. Am I eligible for unemployment? Also work time was 8/2016-11/2017 and its now 6/2018 so if I am eligible, is it too late to file? I’m not having luck finding work!!

    • Carolyn,

      Unfortunately, personal reasons are not considered. You will not be eligible since unemployment insurance is only extended to those who become unemployed due to involuntary reasons.

  5. I live in PA and filed for unemployment in MD. The PA income tax web site says that I don’t have to pay taxes on my unemployment in PA. Do I have to pay Maryland for the tax on the UE benefits?

      Your employer would have paid taxes into the state where they have registered. Please call your employer for details.

    • If there is not additional processing required and assuming documents are in place, you should receive the first payment in about 7-10 working days.

  8. i received my benefits yesterday. I used my card twice yesterday and now it won’t let me use it anymore. What do i need to do so i can get the rest of my money?

We have a seasonal layoff period in the winter and some employees that are temporarily layed off are asked to do other than normal functions like snow removal a couple of days a week or as needed. Is there a minimum and/or maximum benefit the employees can receive? How does working 1 or 2 days effect their benefit?

  10. I am a full-time Maryland Resident. I was let go of my previous employer in Feb 2016 and received unemployment via Virginia until this month. I have applied for 78 jobs without any luck. Rejected by some due to age discrimination. Can I now apply for unemployment in Maryland ?

    • If you’ve exhausted the allocated benefit weeks in VA, you will not be able to claim from MD.

  11. I have an employee who has worked for me around 90-100 days. He was on unemployment for a few weeks before I hired him as he was laid off from a company he had worked for for several years. If I lay him off who will be responsible for his benefits me or his previous employer? How will his benefits be calculated? Thank you for your help

    • The responsibility generally lies with the current employer.

      You can call the Unemployment Office to confirm the mechanics.

  12. If an employee is laid off for a short time(2 weeks) , brought back to work (2 weeks), and laid off for another short period (2 weeks), is he eligible for unemployment each time he gets laid off? How long of a period of time does he have to be laid off before he is eligible for benefits (1 day, 1 week, 1 month)?

    • If this is an ongoing situation, the employee can be eligible for UI benefits.

  13. I’m filling out an application for clearance and need to have my job history for the last 7 years. Around 6-7 years ago I was drawing unemployment benefits from Maryland but do not know the dates that I collected from. Is there a way I can find out the dates I received unemployment benefits?

  14. I retired from and currently receive a pension from the state of Maryland. To make ends meet I had to take on full time employment not connected to the state of Maryland, however I was recently laid off from this job.

    Even though I receive a pension from Maryland would I still qualify for unemployment due to the loss of my current job?

    • Some states do provide Unemployment Insurance along with pension.

      Please call the claims center/customer service of the labor dept. in your state for further information and apply accordingly.

  15. why is it that i worked for a company for about 4 years plus. went out on medical leave and the doctors still don’t know what is wrong after a year, i get let go from work so i apply for unemployment and they tell me im qualify for benefits but since they base it off a 18 month time frame i get $0. why is it a 18 month time frame when i have put 4 + years into a company.

    • I can understand your plight. However, the base period will be the preceding quarters.

      Please inquire with the labor authorities in your state to see if there can be a concession.

  16. due to a brian illness my employer says i am no longer to adequatley do my job and has given me thirty days to find another would there be any medical benefits if i am not able to find employment

  17. am I able to file for unemployment from being out of work due to a auto accident injury? How do I go about doing this, I was working full time until the day of the accident. I am still on the pay roll at my job.

    • You may not be eligible to file as the accident has put you to rest for some time until recovery.

      Please explore the options available under the workers compensation act for any benefits.

  18. I want to withdraw my claim…only three weeks. I found a part time job. Explaining again and justifying is very hard on me.

    My employers are fighting and I feel not what I experienced…the events greatly miss perceived by them…or they are lying.

    I want to withdraw . Have received no money. Filed NO more than three telacerts

    I’m done. Forgive and move on. Found work to. Can I withdraw?

    • You can withdraw.If you filed online, please log onto your account and check for a relevant option to withdraw.

      Else, you can also call the claim information center on 1 – 800 – 827 – 4839 for a procedure on withdrawal.

  19. I worked for an organization for 6 months and I was wrongfully terminated. Why when I applied for unemployment, I received that my benefits will be paid by my prior employer and not by my last employer

    • All employers pay certain taxes which is funded to pay out weekly benefits for unemployed citizens.

      It should not matter where it is coming from as long as it is legitimate and beneficial.

  20. I have worked Jan thru Oct in PA. NOW, I am working thru a Missouri based contractor, physically in Baltimore, MD (3 month contract). In Feb. of 2014 when the contract ends, where do I file unemployment? PA or MD?

    • if I leave my job due to my health, will I be eligible for unemployment, pending the time that I will found another job.

      • If the illness is due to work, you may explore workers compensation for related relief.Eligibility to UI depends on your availability to work in the future.
