Oregon Unemployment Eligibility

Following are the monetary and non-monetary eligibility required for qualifying for UI in Oregon.

Monetary eligibility

Eligibility is decided based on a one year period called as the base period which is the first 4 of the last 5 calendar quarters completed at the time you file your initial claim. To qualify for UI

monetarily you must –

  • Earn at least $1,000 in wages during the base period. This amount is subject to UI law. You must also have total base year wages that add up to or equal one and half times the wages earned during the highest quarter of the base period.

-or-

  • Worked at least 500 hrs and earned wages subject to  UI law during the base year.

Non-monetary eligibility

Following are the non monetary eligibility criteria to qualify for UI in Oregon

  • Candidate must be unemployed through no mistake of theirs
  • Applicant must be able, willing and available to perform full time work
  • Unless seeking work elsewhere, claimant must be residing at the address of permanent residence for major portion of the week
  • If you were fired or if you quit, reasons behind this should be genuine and pressing
  • Claimants must actively seek new job opportunities and must register themselves with any job hunt systems

Eligibility questions

If I was fired from my job, will I qualify for UI in Oregon?

In most cases, being fired because of an action of yours, will almost instantly disqualify you from UI benefits.

However, the law understands that in some cases the employee is innocent and that the termination of his employment is at the will of the employer. If you were fired for reasons like discrimination or any such criminal intent, you will be eligible for UI.

However, you must be able to prove to the authorities that you were unfairly fired. Termination with just causes, which means causes that can be attributed to your behaviour or actions, eg timeliness, lack of discipline etc will never be excused.

Will I be eligible for UI if I got laid off from work?

Yes. Most probably. Getting laid off means that the employer let you go for reasons like lack of work or cost cutting. This means that you had no role in your termination and that it was not due to your fault. You stand a very good chance to qualify for UI in such a  scenario.

However, losing a job through no mistake of yours is not the only criterion. Claimants will also have to meet the other monetary and non-monetary eligibility criteria.

What would cause the delay of my benefit check or approval for UI?

Benefit checks will be issued only after you are deemed eligible. Some of the issues that could delay your approval or you not receiving benefit checks are as follows:

  • Avoiding an opportunity to work in a specific week
  • Refusing suitable job offer
  • Refusing an employer to whom you were referred by the Oregon WorkSource office
  • Failing to appear for meetings with WorkSource office
  • Not meeting job search requirements
  • Injury/illness
  • Attending school
  • Not being available in the state add
  • Receiving income from sources such as vacation pay, severance pay, pension etc
  • Not restarting your claim after skipping a week
  • Provide false or fabricated information on one of your forms

If an issue is encountered with your application, you will be notified about it via e-mail or telephone. To avoid unnecessary delays, clear the issue off at the earliest.

  1. I accepted a job in car sales after being assured that the dealership had “substantial” daily customer visitations and income potential. It turned out the dealership had a very low customer visit rate, and they had hired too many sales staff. Despite working hard I made no more than minimum wage. I felt the company had exaggerated the pay potential when I joined, so I quit after six months. Can a case be made for UI?

  2. I have an employer who doesn’t really follow the law on breaks and lunches. I know if I complain they will terminate e based on what others have said. However they let you take your breaks later in the day, but the bksss doesn’t always notice you missed lunch and breaks and gets on me for being on my phone at a later time.

    The problem is that the boss doesn’t co front me at the time he sees me and asks me why I’m there, then. Instead he writes it down and brings it up weeks later.

    If terminated for this can I receive benifits?

      If your job is terminated for such trivial issues which aren’t your fault, you should be able to claim. Please make sure to keep supporting documents handy in case of a dispute.

Today I received both a changed job description, twice the amount of work than previously along with a warning letter, for me, I feel harrassed and that I was put in a loosing situation, I know that I cannot do this increased amount of work. Plus they do not pay overtime, but want you to take comp time instead. If I quite because, I am feeling harrasssed, can I collect UI? I am currently doing the work of three people, who were laid off just before I came, now the boss wants more, it is a male dominated agency, I am female. sigh, I don’t know what to do. There is not time to look for another job with this job, I am also going to college full time.

      Please tread carefully. If you have sufficient proof to showcase in case of a dispute, you can quit and claim UI benefits until you find employment.

  4. My supervisor accepted my resignation with the stipulation that I could detract it contingent upon me finding employment and place to live in central Oregon. Well, my employment and housing fell through and my supervisor refused to let me detract my resignation (even though we made an agreement). So, this appears to be involuntary termination?

      If you can provide with a timeline and supporting documents in case of a dispute during claims processing, you should have no issues in weekly claims.

  5. My employer changed my job description by adding a major responsibility and changing the qualifications to match my qualuficayion; I’m over qualified. They would not change my title or increase my wage despite showing them the original job description I accepted. For the last two years, my fulltime supervisor has been flexible with my school schedule and told me she would make it work during my internship, which I believe they did because they would not compensate me for the job description change they made. It feels like a bait and switch. I stayed on based on the flex schedule information, which was verbally communicated. I will be going into internship soon and she recently told me they would no longer let me flex my schedule after this term. I stayed in this job because of the flex schedule. It’s a well known fact that my supervisor is not easy to get along with. Honestly, I feel lied to since I would have left the job if I had known this was all going to happen.

  6. I am suffering with a long bout of anemia and the Doctors are still trying to find cause. I am paid by the job and lost over half if my work last month due to time out. My question is two fold. One, Am am I eligible to claim list production from last month. Two if I loose the ability to do my work in the future am I eligible for benefits. I have been with my employer for 15 plus years doing pest control . Its very demanding and im worried I wont be able to keep up this summer.

  8. Hi, i worked at this company for 6 years next month, unfortunately i got terminated due to calling in sick for one day and they found out that i wasn’t sick.They called it termination for dishonesty. I’m just wondering if I am qualified since i have 4 dependent kids.

      It can be considered voluntary. However, I urge you to apply since it looks a hasty termination on the employer’s part.

  9. I have been losing lots of hours due to caring for my autistic son via FMLA. I have run out of accumulated PTO, can I file a claim?

  10. I recently left a job of two years. It started well and management was fantastic, but medical problems (that’s I’ve had throughout my entire adult life) forced me to miss a lot of days due to the unpredictability of my condition. I began to hear co-workers talking about me, about my health, saying that I was faking everything just to miss work despite the fact that I was always looking for more hours. They’d never say anything to my face, but a lot of times it seemed to be conveniently within earshot. It was a circle of depression every day I had to go to work: Wake up, dread having to go in, hear people talk behind my bad, feel even worse about it. Management couldn’t really do anything since the other employees were never “being specific.” Is this just another example of “suck it up, at least you’re not starving in Africa?”

  11. I work 40 hours per week. If my employer has to cut my hours to 20 hours per week due to lack of work am I eligible for unemployment? They also offered to have me work for 2, 40 hour weeks, then not work any hours for 2 weeks. Then come back and work 40 hours for 2 weeks and then not work any hours for 2 weeks, to be repeated until work picks up again. Would I be eligible for unemployment under these conditions?   12. I work on the road 90% of the time fixing machines and equipment. I have been stranded twice in cities with no money on the company credit card for hotel, gas, food. Tried to call my boss and coworkers did as well and boss wouldn’t answer. It wasn’t til my wife called (he didn’t know her number) that he answered. This was at 10pm. By the time he got everything squared away it’s 2am and I had to be at my next job by 6:30am. So no sleep pretty much. Then the next day I got hurt moving a 500 pound machine into place and now my boss is harassing me stating he’s calling bs I got hurt because it happened the day after the credit card incident. I’m now on workmans comp for the injury but they have since come and picked up my work van, equipment, and keys to the shop. Also demanding me to come in the day of my drs appointment when I haven’t been released back to work yet and the workmans comp division says I have a 14 days grace period from my last drs release for the follow up dr to backdate. Can I quit for good cause based on the past and current events and seek employment somewhere else once released from workmans comp? Also the boss continues to degrade me and call me names when I don’t know how to fix a machine. Normally they train people for 6-12 months with someone before they are on their own but I was on my own within 2 months because people were quitting and they were short staffed.

      This is a tricky situation. Although, I think you should qualify, please call the local Unemployment Office to inquire further and decide accordingly.

I was terminated when my boss read an email I sent to client stating our commission structure would improve later this year as it is lower than competition and client struggling to do business with us. No details, just wanted to reassure client that things would get better. We are not announcing this to all clients for a few more months.My boss had started trolling through emails without our knowledge – this has never been a usual occurrance but we were bought by another company. I don’t dispute that I communicated this but it doesn’t seem to rise to any level of harm to the business as no details were shared – which I didn’t even have. Would this termination reason exclude me from unemployment benefits?

    1. If you think the decision to terminate you was hasty, you can apply for Unemployment.

      I suggest you speak to the Unemployment Office to confirm before doing so.

  14. I accepted a new position less than three months ago. Since that time the position has changes several times and is no longer a good fit. Can I apply for unemployment if the employeer agrees as well?

  20. I currently work full time (4 years). I have been dealing with a hostile person who tends to decide he is going to make make my life miserable at work periodically by doing things like acting super nice and talkative to others and ignoring or snapping at me isolating, talking over me or ignoring me in group situations. I have approached this problem 2x with management and the owner. Each time they have been very concerned and I have agreed to stay if the offending person apologize changed his ways. Each time this has lasted for a few moths.
    It has begun again. I really don’t want to go through this again with owner and stuff. I really just want to leave. I can get employment elsewhere pretty quick it’s just not full time and it is a large pay cut. Can I quit and take that job and collect UI to help me while I try to get work to fill in the gaps?

    1. Hostile work environment can be a valid reason for resigning and claiming UI benefits. However, it’s subjective in nature.

  21. I work for a non profit organization and have been there for over 11 years new management came in a year ago and I feel I am being bullied into quitting. My boss makes me miserable everyday. I really want to quit but can’t live without some kind of exams to live. Can I get unemployment

    1. You can be eligible if you quit due to hostile work environment. The burden of proof is on you if there is a dispute raised by your employer.

      Also, please check with your employer if they pay UI taxes since you mentioned its a non-profit organization.

  22. I am scheduled for major reconstructive surgery in July and my surgeon is requesting a 6 week absence from work to allow proper healing. Although I am taking OFLA during that time and will be technically employed but not working, would I be eligible for unemployment insurance during that time excluding the waiting week?

    1. If you leave the job voluntarily, you may not qualify.

      However, there are exclusive rules in each state with regard to defense personnel. Please call them for precise information.

  25. My wife left a job in another state to come to Oregon for a new job. She has worked here for six months, and may be let go because she doesn’t meet their training standards. If she is let go will she be able to get UI until she finds a new job.

    1. Contracted employees are generally not eligible. Please ask your employer if they pay the relevant taxes on behalf of you.

      Some states allow provision of both UI and SSI. You can inquire further with the Unemployment Office in your state.

  27. Employee only works 2 days a week because he’s a full time student. We had to hire someone else to fill the position, so we no longer have a need for him. We told him him could work through the end of the month then let him go. Will this employee receive benefits?

    1. If you lay him off and his separation is due to involuntary reasons, he can be eligible.

      There are multiple eligibility checks his application needs to pass through before he is deemed eligible.

  28. I’ve been denied benefits because I was a full time student this past year except the last 9 months. My hours working is 480 and my earning for other quarters was les than the minimum amount required.This was because I was a full-time student. Can I appeal to get unemployment because I was unexpectedly laid off with no definite return date.I’m actively looking for work because I cannot pay rent or even buy food at this point. My question is can I appeal and get benefits in Any way.

    1. Well, you need to have active employment in the last 4-5 calendar quarters to be eligible.

      Your appeal may not hold weight.

  29. I worked for my employer for almost 2 years.
    I’ve always exceeded at my job and loved it.
    A week ago my boss and his wife came into the store I was working at and out of nowhere his wife started verbally harassing and cursing at me while my boss just stood there and said nothing! Her and I got into a huge argument and she personally attacked me. I did absolutely nothing wrong to deserve what she did.
    After she left I was clearly very upset and asked my boss what that was about and he said nothing!!! I ended up quitting. Later that day I was so distraught by what had happened I wasn’t feeling well and went to the local urgent care where I found out my blood pressure was
    189/140!! I am now under the supervision of my doctor and have to be on medication for high blood pressure. I have actively been looking for another job but was wondering if I qualify for Unemployment benefits until I find one

  30. I worked for Holiday Corp for 8 yrs in Florida . I had an attitude problem so says my boss that effectively resulted in my having to retire. This was a choice given to me so that I could possibly work somewhere else for the company rather than getting fired . I am sure if I let them fire me I would be able to receive benefits but not thinking things though I ( retired). Recently our board of directors has partially suspended activity for an unknown period of time resulting in myself and all but two of the employees left sitting in limbo. I work for a nonprofit, due to budget cuts I was left with the option to accept a position in another area (25 miles away from my original location)with a different job description (not provided just an oral description) or to be laid off; and a decision to be made in 20 minutes. I said yes, but the commute cost is higher than expected, work load is completely different and there is not a proper training. May I qualify?

    1. Depends. Please check with your employer if they pay unemployment taxes on behalf of you.

      Also, if a person quits citing personal reasons, they may not qualify.

  36. I am a foreman for a business were I had almost no training , feel that myself and other co workers are belittled, unsafe work equipment in my opinion not OSEA approved. All employees there constantly complain of our employeers lack of caring of them or the equipment we use……. My question is if a person were to quit a job what are or where can they find information to quit this job yet still be eligible for UI Benefits, so they can have income to look for a better job and work environment

  37. I am a commercial pilot, employed in the state of Oregon for over 7 years, but have always lived outside the state. I am thinking of starting a family, but the contracts available with the company I work for will not accept a pregnant pilot. I would still be able to work, however finding employment while pregnant would be nearly impossible as a pilot, and it would also perhaps preclude the FMLA as I wouldn’t be eligible if I were a new employee or in the case that I actually find work and it were with a small operation.
    I’m sure I could conceal, with risks, a pregnancy for at least the first 4 months and perhaps longer. But still, it would put me outside the OFLA for up to 36 weeks of leave. I’m assuming I can procure short term disability but I am not sure for how long, and I don’t know if long term disability would apply in this case, or if I could even collect disability because I could still perform other jobs, even though it is not in my career that I have had for over 11 years.
    This actually happened last year for a number of months, as I was pregnant. The company “ran out of work” for me and I was put on “on call” status (not fired or laid off, but given no opportunity to work) and my health insurance was cancelled because I wasn’t working to pay for it. I’m concerned about the vulnerable place this puts me in and I would like to be fully informed if this were to happen again.

    1) Would I be eligible for unemployment if no work was made available to me by my present employer due to a pregnancy?

    2) How long would this unemployment last? Would I be required to take any job that was offered to me, even if it would disqualify me from FMLA and OFLA?

      Personal reasons like pregnancy is not considered for Unemployment Insurance. Benefits are only provided to those who lose their job due to involuntary reasons. Unemployment benefits can last up to 26 weeks, depending on the state and approved duration.

I am confused as to the involuntary portion of it – I did not nor would not voluntarily leave my job; I was and would be forced to if I were found in this situation again. They do not allow pregnant women in my position. Wouldn’t this qualify as an involuntary separation? Thank you for clarifying.

  38. unemployed for 2 reasons, medical issues caused me not to be able to do my job like I used to, and relocation due to husband gaining better position. I did voluntarily resign though. Would I qualify?

  41. I was fired today. I have an app that records calls. In my state this is legal. My supervisor said that “Yeah, I know it was not your fault but the client was mad so they had to let you go”. Can I qualify?

    1. You can, as long you have all the required proof in case there is a dispute and you can justify your case.

I have been working for my employer for over a year now and just recently been told if I didn’t commute to whatever facility in the region that hours were available that I would have to use vacation time. I have requested to go to part time and not have to drive all over the place. When I was hired I told them I was leaving my current job because I didn’t want to commute 79 miles a day anymore and they stated they could accomodate me by having me float to buildings within 16 miles from my original building which is already 29 miles from my home which I agreed to. Now they have stated there is no part time work available and I WILL be required to go wherever the hours are when needed which is not what we originally verbally agreed upon in my interview and why I took the job. My manager has always told me its my choice if I want to go further to other buildings or not but now they are demanding that I go or they will take disciplinary actions against me and quoting policy and procedure. I BELIEVED at time of hire this was a verbal contract that I wouldn’t have to go further then the stated buildings UNLESS I agreed upon it and both times I agreed to go further I expressed afterwards to my manager that it was just too much commuting and I didn’t want to go back there again. I have now been caused so much stress I had to go to my doctor and request sleeping and anxiety pills due to the stress of the whole situation. I have written letters asking to go to part time, explaining why I want to go to part time, and stating how I believed that this wasn’t going to be an issue upon hire. They have NEVER made me used my vacation time prior to this to make up for hours either or when I declined to go someplace that was too far away. IF I quit would I still be eligible for Oregon UI while I was looking for another job. I have several applications in already and may just possibly take an on call position but I will not have medical insurance then. I don’t know what the next step to take is. Please help

  43. If I have applied for 2 different positions. Job #1 is a better fit for me personally than Job #2 and Job #1 is the one I want more but Job #2 is offered to me first. If I don’t accept Job #2 right away because I think I will get an offer from Job #1. Would that disqualify me from benefits if for some reason I don’t receive an offer from Job #1 and then Job #2’s offer is rescinded because I waited too long to accept it?

So what you are saying is because of the rules from unemployment about losing eligibility for failing to accept work, that in this situation I would be forced to accept Job #2 even though Job #1 is a better fit for me. If I were to accept Job #2 and then Job #1 was offered to me, that would put me in a very uncomfortable position. As I would have to decide whether to do what is right for my career or worry about my reputation if I burn the bridge of the second employer by abandoning/reneging on my obligation in favor of the job that is right for me. I should be accepting work that is right for me and not forced to take the first offer that comes along. That policy doesn’t sit right with me.

  44. My employer is eliminating the position I was hired for two years ago but offered me a position in which I would have to work swing and graveyard. I am in graduate school and have a minor child at home (single parent). Can I file for unemployment due to the fact the position/hours I was fired for is being eliminated?

    1. Depends. Voluntary resignation usually does not qualify for UI benefits. But then, you have a genuine reason.

      If you decide to leave, please consider applying for UI benefits until you find a new job.

  45. I am a part-time instructor for a community college. I am scheduled to teach two classes (the same two classes I regularly teach each term) this Spring. However it looks like those classes will be cancelled due to low enrollment. Will I be eligible for unemployment if those classes get cancelled?
