Texas Unemployment Eligibility

Non monetary eligibility

  • Claimant must be unemployed
  • Claimant must have lost his/her job due to no mistake of their own
  • He/she must be available and willing to do full time work
  • Reason for job separation must not be gross misconduct or other disciplinary issues
  • If the claimant quit the job voluntarily, it must be on strict medical grounds or other well documented reasons

Monetary eligibility

  • Claimant must have earned wages in no less than 2 out of 4 calendar quarters
  • Total base period wages must be at least 37 times your weekly benefit rate
  • Claimant must have earned at least 6 times the new WBR since the time he/she qualified on a previous claim

If you were unemployed for an extended time during the base period because of a medically provable illness, injury, disability, or pregnancy, you may be able to use an alternate base period. If you meet the requirements, TWC (Texas Workforce Commission) could use wages you earned prior to your illness or injury. In case you meet the criteria under both a regular and an alternate base period, you decide which base period to use.

Eligibility Questions

Can I collect unemployment if I am fired?

You can obtain unemployment benefits if you were fired without work-related misconduct.

Examples of misconduct are:

  • violation of company policy
  • violation of law
  • neglect or mismanagement of your position
  • failure to perform your work acceptably if you are capable of doing so

Upon getting fired, the ex-employee can file for unemployment benefits. Whether he gets it depends upon the situations of the firing. If the unemployment board grants unemployment, the employer has the right to appeal the decision and to show evidence why the unemployment benefits are not warranted.

In Texas, if an employee is fired due to misconduct, the employer will need to show documentation to support his case at an unemployment hearing.

Can I draw unemployment benefits if I quit?

You can collect unemployment benefits if you quit your job for a good well-documented work-related or medical reason. You should be ready to present proof that you tried to correct the problem before you quit.

TWC (Texas Workforce Commission) may rule good cause if the work situation would cause a person who truly wants to keep the job to leave it.

Examples of possible good cause are:

  • Unsafe working conditions
  • Significant change in hiring agreement
  • not receiving payment for your work

Examples of medical reasons are

  1. Quitting on your doctor’s advice, or
  2. Quitting to provide care for a minor child who has a medically verifiable illness if there is no alternative care provider, or
  3. Quitting to provide care for a terminally ill spouse if there is no alternative care provider.

You can also collect unemployment benefits if:

You quit to protect yourself from family violence or stalking, evidenced by an active or recently issued protective order, a police record documenting family violence or stalking directed against you, or medical documentation of family violence against you.

In addition:

If you quit to move with your husband or wife, you may be able to receive benefits after a disqualification of 6 to 25 weeks. This is a disqualification of both time and money, because the unemployment office must subtract the number of weeks from your total benefits.

If you quit to move with your military spouse, Texas lets you collect benefits without a disqualification if your spouse has a permanent change of station longer than 120 days, or a tour of duty longer than one year.

Can I obtain benefits if I am laid off?

Texas entitles you for unemployment benefits if you are laid off due to lack of work.

When you get laid off, it is not your fault. In almost all cases, this means that if you get laid-off, you are qualified to obtain unemployment benefits.

You should immediately apply for unemployment benefits if you get laid off. Getting laid off simply means that you left job through no fault of your own and the company did not have enough work for you and could no longer pay for the job.

  1. I am employed for a construction company that my job is for 9 months. I was told if a new job come up I could be sent to that one. They do have a job site, but the supervisor says he doesn’t need me. Which comes to my question. Can I claim benefits once this job is over?

  3. I had an knee injury that isn’t work related. I’ve been on light duty due to Dr’s orders for a month now. Today I had an appointment and was told I need surgery for a torn ACL and meniscus.   4. I have been working part time as an Office Assistant for the past 10 months, for a construction company. I was warned by a co-worker that our boss was occasionally a little loud and I thought nothing of it. The first time I heard him scream was startling to say the least. He screamed at both myself and my co-worker using extreme profanity over something that was out of our control (ie, the slow time of year). The next few times he screamed profanity at us was because of something he did. I politely asked him to stop screaming. He told me “F-you. It’s my office.” He’s called me stupid on many occasions and screams profanity at us constantly. I have audio of him screaming about one of our financial supporters, calling them horrible names. I have started seeing a Psychologist because of my boss. I have been told to quit because my mental and physical health has declined. I have had more migraines since I started working for him and I go home everyday sick to my stomach because of his screaming. I started looking for another job and have had a couple of phone interviews but nothing so far. Could I get unemployment until I find something else due to my current situation at work?

  5. I live in Houston and during the recent hurricane, my vehicle suffered water damage. I live in the Harris County part of Houston, where we do not have bus service. As a result of the storm damaging my car, I have been unable to get to work. My employer emailed me and said if I didn’t show up on Wed, Sept 20, 2017, they would accept that as my resignation. I responded letting them know I politely decline to resign and that I politely decline for them to use the Sept 20 absence as a voluntary resignation because I am unable to get there due to no fault of my own, but as a direct result of Hurricane Harvey damaging my vehicle, which is being repaired. I also informed them that I know they have business needs and will discharge/fire me because I am unable to be there on Spet 20th. I even informed them that I tried renting a car, but there is a shortage and a waiting list. Will they be able to stop me from getting unemployment although my reason for not being able to make it into the office was due to no fault of my own?

  6. I have been with my employer for 5 yrs. never received a write-up until this month. I received a suspension and then a written out of nowhere. Now my performance is being scrutinized and I am the only full time manager in my department. Per a FMCSA official’s last audit of our company, there needs to be at least 2 full time persons in this department in order to maintain DOT compliance. I have been by myself for over a year and unable to do all of what is required. I have brought this to my boss’s attention multiple times and yet he has refused to hire someone else. He recently got onto me bc he asked me to fulfill a task, which I have presented to him plenty of times, but he has still not approved the purchase so that I could complete the task. It has gotten so bad that the office manager has made comments to my colleague when I leave after 5pm (5:10pm). My work schedule is 8 to 5 Monday- Friday. If I quit, do you think that have an unemployment claim?

  7. I am currently working at pittsburg nursing center and with the number of residents is low the hours have been cut from full time to part time can I file for partial unemployment

  8. I was hired as an Aircraft parts fabricator. They have no work in my department. I have documented me not being distributed any job for over 3 weeks. They won’t lay me off. I have been getting harrased. My manager yelled at me and I have it on tape him admitting yelling at me. I have been harassed by others also. A certain manager is mad because I sent a email to him and the president of the company asking him why They took me off the aircraft to send me back to a shop with no work. He got mad. They have put outside contractors doing a job I can do on the aircraft.
    They are trying to make me quit or fire me instead of laying me off. They transferred me to building maintenance. I was not hired for that position. It is demeaning and now that supercvisor is harrasing me also. I am also on a life saving drug that has several side affects for 90 days. I am really stressed and dont know what to do.   9. I started working as of June 3, 2017 and I’m facing a hostile working condition. It has gotten to the point where I’m getting anxiety and depression because I’m unable to be home early enough to care for my sons. I’m currently separated and I do not have appropriate childcare for one of them who is special needs. I work Monday thru Saturday with hours varying sometimes until 8pm during the week. I cannot just leave work the same day to tend to them in case of something going wrong. Also, the manager who I work for is also always on my case, she creates a hostile working environment where she herself is not people-friendly (mind you we work for a property management co. We need to have people skills) I brought it up to her attention but she keeps being making rude remarks and sarcastic comments. She told me not to go above her for any complaints and for me to keep it between her and I. I called my regional manager, but I was not able to talk to her, she was already on the phone call with my immediate manager so I don’t know what they talked about me. I don’t feel comfortable.   12. I have a real confusing one. I was recently terminated by a company I worked for as a contracted employee. The company I work for just pulled me from my position and explained to me I was not going to work that contract anymore, however, I was still employed with the company. My boss wants me to stay until he finds other contracts for me to work. So I then applied for Unemployment and was awarded the unemployment. Now after a month they scheduled me with a phone interview. I am still confused as to why, or what I am to tell EDD when they ask my status. Confusing as I am still employed by my company but terminated from the post I was working at due to an employee disagreement. I am also a Disable Veteran that is suppossed to be protected in such cases, and to top off the confusion the organization that terminated me was a government agency. All is BS especially the way I was treated in the incident. Any clearity would be helpful??

  13. I was laid off from my job of 2 years. I did not file unemployment as I went to work a few days later with another company. The job was set as an 1099 for the first 90 days then onto their payroll. I was let go last week, after only 2 months as they lost a large contract.

  16. My position in Houston was eliminated and I was sent to work offshore in Egypt. I was informed the rotations would be 4 weeks on and 4 weeks off. Since moving to this role there has been no consistency. 3 weeks on, 5 off. 4 on / 3 off. 3 on 2 off. Now they are stating the rotation is 6 on 4 off. My wife also works and is now required to travel and this puts us in a serious situation because we have children and will obviously need to be home to care for them. If I resign could I possibly qualify for unemployment. The position schedule has not been as stated from the beginning.

    I was in an accident not at work I have been off work about one month and was told my job was not in jeopardy and not to rush my recovery
    Then suddenly they decided they were going to have to hire someone else, so I practically begged to keep my job as that is my only income. I went back to work and had a dr appt the same day. I was given work restrictions recommending part time and flexible hours trying to work up to my normal 8 hour day. They chose not to honor the Drs recommendations

Just asked to sign the back of a “company check” & then handed our net pay (but in cash) as we received when we were getting normal paychecks/direct deposit. We have now not even received our W2s. I was due my pay this past Friday & tomorrow will be 1 week with no pay (next pay date is in 1 week). Will I be eligible for UI benefits if I quit?     1. I complained to HR (via telephone – I have someone who witnessed the call) that my supervisor was discriminating against me because I was a male. I consistently noticed she was giving female co-workers more hours than I.

    2. Two days after I complained, my supervisor scheduled a meeting with our HR director.

On the day of the scheduled meeting, as I approached the building where the HR director works, I was intercepted by her, and the Chief Operating Officer of the company, and was told that we would not be meeting with HR. I was placed on a performance improvement plan. One of the issues mentioned was me not being tardy to work.

    4. In addition, my supervisor immediately changed my work hours from working overnights, ex: 11 PM to 6:30 AM, to working days, ex: 10 AM to 5:30 PM.

    5. The first day I was to report at 10 AM, I was 9 minutes late to work. Largely due to me not being able to sleep, as I was used to staying up all night for work. In addition, there was some sort of training scheduled at our facility that day, and there was no parking spaces available at the facility. I drove around for 10 minutes, and finally found a place.

    6. Towards the end of that same day, I was called in by my supervisor and the Chief Operating Officer and fired for being late. When I told them about the parking lot being full, my supervisor pointed out that I had failed to fill out a piece of paper that was job related. In other words, it didn’t matter what I said, she was determined to fire me.

    7. I feel like my supervisor was retaliating against me for complaining to HR. No one else on our team had their work schedule changed in such a drastic manner.
