Utah Unemployment Insurance benefits are available to assist unemployed workers. In order to receive benefits, claimants must meet the eligibility requirements outlined by the Utah Department of Workforce Services.

How to qualify for Utah unemployment benefits

In the state of Utah, the eligibility requirements for unemployment insurance benefits include:

  • You have earned qualifying wages in your base period
  • You are unemployed through no fault of their own
  • You are able and available to work full-time
  • You are actively seeking full-time work

Monetary Eligibility Requirements

The first thing the Utah Department of Workforce Services will look at to determine eligibility is whether you earned enough money during the base period.

The base period is the 18 months preceding the week you apply for benefits. It is the first four out of the past five calendar quarters. The calendar quarters end on March 31, June 30, September 30, and December 31.

If you do not qualify using wages from this base period, you may still qualify for benefits using an “alternate base period,” which is the four most recently completed calendar quarters.

Wage Credits

A wage credit is any money earned while working for an employer. You must have earned wages in two or more quarters during your base period. You must also have earned at least 1.5 times the wages you earned during your highest quarter. The minimum amount of money earned must be at least $4,800.

Non-Monetary UI Benefit Eligibility Requirements

Only those who are unemployed through no fault of their own and are willing and capable of accepting full-time work are entitled to receive unemployment compensation. Your eligibility can only be established once you file your initial application and the relevant information is obtained from both you and your former employer.

You are also required to complete the online Work Registration for Job Placement Assistance form with the Department of Workforce Services.

If you reside or move to a state other than Utah, you must register with the nearest Utah job center and provide proof of registration to Workforce Services. If you fail to register within 10 working days of applying for benefits, your benefits may be denied.

How many weeks of Utah unemployment do I qualify for?

To determine the number of weeks you’re eligible to receive benefits, multiply your total wages for insured work paid during the base period by 27% (ignoring any fraction of $1), and then divide by your weekly benefit amount (also ignoring any fraction). You’re guaranteed to receive a minimum of 10 weeks and up to a maximum of 26 weeks of regular benefits.

Maintaining Eligibility

Filing Weekly Claims

After you’ve filed an initial claim, you must file a weekly claim to continue receiving benefits. This requires reporting all work and gross earnings, irrespective of whether or not you’ve been paid yet.

You must also contact four Utah employers and record the results of your work search activity. Failure to file a weekly claim may result in a denial of benefits, payment delay, or possible overpayment/penalties.

Workshops and Assessments

You may also be asked to take part in various job searching activities, such as completing online workshops, attending in-person workshops, or participating in an in-person Re-employment Services and Eligibility Assessment appointment to help you in your job search. If you fail to participate in these activities, it may lead to a denial of benefits.

What is Considered Suitable Work?

The suitability of a job is determined by how long you’ve been unemployed. If you’re looking for work comparable to what you did before you were unemployed, you will be given time to find such a job, provided there is a reasonable expectation of obtaining it.

However, as the duration of your unemployment increases, you’ll be expected to be flexible about your earnings, working conditions, job responsibilities, and the use of your prior training.

Can I Receive Benefits While Self-Employed?

You are required to promptly report any self-employment or commission sales activities to both a Claims Center representative and on your weekly filing. Engaging in such activities, even if you haven’t earned or received any wages, could lead to the rejection of your benefits. Failing to notify a Claims Center representative could result in penalties and overpayments of benefits.

What Would Disqualify Me from the Utah Unemployment Insurance Program?

Even if you meet the earnings threshold, you must meet additional criteria to qualify for an unemployment benefit. If your separation from employment meets the criteria outlined in the Unemployment Insurance law, you will receive benefits for the weeks you claim, provided there are no other issues on your claim.

If your claim is rejected, you will be given a written decision that explains the dates and reasons for the denial. The decision will also contain instructions on how to appeal the decision on time.

You may not receive benefits if:

  • You resigned from or were terminated from your job
  • You are jobless due to a strike
  • You are unable or unwilling to actively seek full-time employment
  • You refuse or neglect to apply for appropriate jobs
  • Your earnings are equal to or exceed your weekly benefit amount (including wages, vacation, holiday, or severance pay)
  • You are self-employed or earn commissions

This list is not exhaustive and there may be other reasons why benefits could be denied.

What can affect my claim for benefits?

Several factors can affect whether you are eligible for benefits. These factors include:

Work availability

To be eligible for benefits, you must be physically and mentally capable of working full time. If you are unable to work due to illness, injury, leave of absence, or any other reason, you may not qualify for benefits during that period.

You are required to notify the Utah Department of Workforce Services if any condition arises that could prevent you from working, accepting work, or seeking full-time employment. This includes but is not limited to: injury, illness, hospitalization, loss of child care, or loss of transportation. If necessary, you may be asked to provide proof of your ability to work, such as a doctor’s statement.

You must be readily available to accept full-time work without unreasonable restrictions on hours, wages, or travel distance.

If your employer is holding your job while you are on an approved leave of absence, you will not be considered available for work.

Vacation, holiday, severance, or separation pay

You are required to report all vacation, holiday, severance, or separation pay you have received or expect to receive, as these payments are generally considered earnings.

If the total amount of such payments received in a week is equal to or greater than your weekly benefit amount, you will not be eligible for waiting-week credit or unemployment insurance program benefits during that week.

Training or school attendance

Your availability for full-time work and eligibility for benefits may be affected if you participate in job training or attend school. You must report any school attendance or training to us when you file your weekly claim, even if it is mandatory training required by your employer.

In certain circumstances, attending school may be approved while receiving benefits, but approval is subject to specific conditions.

Foreign travel

If you are traveling or residing outside of the United States, you may not be eligible for unemployment benefits. You must report any foreign travel when submitting your weekly claim. Failing to notify Utah’s Department of Workforce Services of travel outside the United States may be considered unemployment fraud.

Incarceration

If you become incarcerated, you must notify the Utah Department of Workforce Services immediately. Once notified, Workforce Services will discontinue your unemployment benefits until you notify them of your release. Failing to inform Workforce Services of your incarceration may result in overpayments and penalties.

When do I no longer qualify for Utah Unemployment Benefits?

You no longer qualify for Utah Unemployment benefits after you have received four consecutive weeks of earnings that are equal to or more than your benefit amount, or if you have failed to file a claim for 27 days.

If you find sufficient full-time employment and wish to close out your claim, you can do so by contacting the Claims Center.

If you lose your job again, you will need to open a new claim and start the application process again.

    • Hi, Daniella – it is possible in some cases to be approved for UI benefits if you are forced to quit your job in order to care for a loved one who is ill.   2. Hello! My company that I’ve worked with 5.5 years terminated me due to a few of my fmla days not being accepted due to a medical condition. I was recently on disability. I work a heavy lifting job and have asked to transfer departments multiple times but they would not. I’m able to work but not a super physical job any longer. Would I be eligible?

    • Hi, Cheltsy – at their core, unemployment benefits are designed to help provide a financial bridge for people who lose employment through no fault of their own. This is pretty clear-cut when it comes to situations like layoffs or reductions in force. But there are other situations in which a worker can receive UI benefits, depending on the reason given for the termination. Has your company shared with you the reason for termination? Once you apply for benefits, the Utah unemployment office will reach out to your previous employer to confirm whether you separated from employment through no fault of your own, or whether your employment was terminated for just cause. What they say has a big impact on whether your claim is approved. You may want to work with a qualified unemployment lawyer, who can help you understand the specifics of your claim. You’ll essentially need to show that the physical environment is so detrimental that it leaves you no choice but to quit. Otherwise, you might look into Social Security Disability Insurance benefits since your situation is related to an ongoing medical condition.

    If an employee was fired for creating a hostile work environment and immediately after found and started working full time at another company but after a year with the new company was laid off can that person come back to our company to try and claim unemployment?

    • Hi, Jessica – it’s very unlikely that the employee in question would be successful with an unemployment claim naming your company as the previous employer. First, unemployment benefits are designed to benefit those who lose their job through no fault of their own. If your company has documentation that this person was fired for cause, then it’s unlikely that the person would be approved for benefits. In addition, since the employee in question has been laid off from a subsequent employer, any unemployment claim should be connected to that employer instead of your organization. Hope that helps!

  4. I got fired recently and got approved for unemployment but the industry I’m in is small enough that it is easier to start my own business than try to find another job. Am I eligible for unemployment if I am working daily to create my own full time business?

    • Hi, Tori – in some cases, it is possible to collect partial unemployment benefits, even if you are working part-time or freelancing. You should connect with someone in the Utah unemployment office to discuss the specifics of your case. If you are eligible to continue collecting unemployment benefits while working toward your own business, you’ll need to report the work you’re doing each week as part of your weekly claims, and your benefit amount may be reduced accordingly.

  5. I was recently laid off. I will get a one-time severance payment sometime soon. Will I be eligible for unemployment after that payment comes through? Can I file now before I receive that payment?

    • Hi, Jenny – Under Utah law, a former employee is not eligible for unemployment benefits “[f]or any week with respect to which the claimant is receiving, has received, or is entitled to receive” severance payments, vacation payments, or other leave payments. So if, for example, you receive two months’ severance, you will not be eligible for unemployment benefits until after two months have passed.

I quit my job with two months notice on February 1st. 2020 to prepare my home for sale, then find a job more locally so my wife and I could move in with my mom (78yr old widow)who is suffering from dementia. I’m an industrial electrician and have always been able to obtain employment quickly. In the beginning of January 2020 I caught covid, but didn’t know what it was. It had not hit the news yet. Over it in mid January and went back to work for two weeks before I was going to quit. Because of the hysteria I decided not to make the visit with my mom to tell her the news for another month. Well things went horribly wrong with my plan of moving in with her. She was adamant that she was fine and didn’t need any help. I didn’t know what to do. I tried to get unemployment and was denied. Figured, no biggie I’ll just get another job close to home and deal with my mom as things progress. Well, a couple more months went by with no job offers, thanks to the covid confusion, so I decided to file an appeal on my unemployment judgement. I explained everything as best as I could to the judge and was denied again for failing to appeal within the allotted amount of time. Why would I be treated as if I had done anything wrong? I was sure my case had plenty of merit to be considered in good conscience. I’m still struggling to straighten out all the problems that came from this lack of compassion. I couldn’t control the way my mom did react and the pandemic and the fact that the economy was in a tailspin. Of all the people who didn’t deserve the benefit help, i got slapped

      I can understand your situation. Unfortunately, the law does not consider personal reasons for losing employment. UI benefits are only offered to claimants who loses employment due to involuntary reasons.

  8. I am going to school that is paid for by the VA. It is out of state, would I still be able to collect unemployment?

  9. I quit my previous job for more income in January 28 th started my new job on February 3 was let go March 21st. My net income during that time was 6280.00 from the employee that let me go. I got a response of pending denial cause I quit my job in January for this higher paying job. I met the criteria on earnings during this time. I’m confused and upset especially during this time.

  11. If my business is temporarily shutdown by the government as a result of the Coronavirus, are my employees able to apply for unemployment with the State of Utah? Is there any requirement that I continue to pay my employees during the shutdown?

  12. If my employer doesn’t have work going on 4 weeks, when I as hired for full time work 6 mos ago, can I apply for UI due to basically being temporarily laid off?

  13. Question: If I was terminated due to performance issues and the company gave me a severance package as well as mentioned they would not contest my unemployment application, would Utah state consider that as a “firing”? And deny me unemployment benefits?
    The company I worked for feels I should appeal the decision.

      UI benefits are only extended to claimants who lose employment due to involuntary reasons. Not sure if you stand a chance. If your employer says, they wouldn’t contest, you can consider appealing.

  14. My daughter was put on probation at her job because they thought she was padding her time sheet. There was no proof either way since it was so far in the past, so they could not fire her. She made a mistake on an invoice that was caught before it was mailed to a customer. She was fired for making a mistake while on probation and told they would fight her on the unemployment since they felt she owed them money on the “padded” time sheets. If she does file for unemployment, what type of proof is required on the part of the employer to deny paying benefits? She was not fired for the reason they say they will fight the unemployment claim. How does that all work

      If your daughter thinks she has a strong case with supporting documentation/evidence, please ask her to file for Unemployment. The employer might dispute the claim and she may be asked to prove her stance.

  15. My position at my job has been eliminated. I have been offered a severance package equal to one weeks pay for each year of employment with the company which is 10 years This will be paid to me in one lump sum. Will I be eligible for UI emediatly after I receive the payment or will I be required to wait the 10 week before receiving UI. Also should I apply for UI immediately after my employment ends or after I receive the severance payment.

  17. I have had my job as an office manager for 6 years. 2 years ago my workplace was bought out. I have a full time 40 hr a week full benefits position. I just found out that they are reducing my job to a seasonal part time 25 hr a week 30 weeks a year position with no benefits. Can I collect unemployment? I feel this is a move that they are making to force me out.

  18. I was working for a school district and doing consultation part time since september 2017. Come november director asks me to come on full time salary with benefits. I accept in January 2018 and february 20 am told salary model is going away and hourly will replace it. Then i met with hr to discuss an issue with a director over 15 hours weekly/multiole clients and am put on hourly a month before other consultants and taken of that case load effectively cutting my hours to 20 per week. Half time. This is insult to injury as i left a salaried teaching position with the promise of salary and full time. Now i am cut way beck and i cant afford their health insurance. I have 4 kids. We were buying a house and now my process to be board certified is slowed way down. Not sure what to do. I feel like i should sue. Too busy surviving now.

  20. I have been with my employer for nearly seven years. The company is being sold with new ownership coming in. I have been asked to stay in my position as manager. My current boss feels like the new owners may cut my wages. Do you think I would qualify for UI if I leave my position?

  21. I had worked for a company in a contract for 4 months.And right now I have been trying to get a full-time job since last 2 and half months.

  22. Our company is merging with another Company and I was told they will not need me, I will be getting a severance package but it is only for a few weeks. Can I get Unemployment when I leave?

  23. I quit my very stressful job because I never got a lunch or any breaks. I didn’t submit my own time, my boss did (I was hourly). I worked 9 hours every day and got paid for 8 because she didn’t want to get in trouble for me working overtime. On top of that I was required to bring home a company cell phone and was required to answer it and only got paid for the time I was on it (2-3 minutes a call). No consideration of the fact that I was always “on call”. I didn’t have any time off. Can I receive unemployment benefits?

  24. I started my job last Dec . Now it’s end of August . I was doing scheduling and appointments and marketing from home and was paid a set amount every two weeks. They never had me sign any papers or had my social . They set me up a company email. Suddenly they said it was slow and let me go. Am I eligible for unemployment?

  26. I currently work as a teacher at a charter school. The teaching contract is per year and I was informed that I was not asked to return to teach in August. Contractually I will receive my salary through the end of August. This was not an immediate job loss, just asked not to return the next school year. There are other teachers in this situation as well. Will I qualify for unemployment benefit? How do I know if my school has paid into the unemployment tax? If I am qualified for unemployment, when should I apply since I will still be receiving a salary through the end of August?

    • As you said, you will only qualify if your employer has paid Unemployment Taxes. You can find out by talking to someone from the HR department in your school.

  27. I have been with a company for 8 months now. I’m due to have a baby at the end of this month they are requiring me to put in my 2 week LOR because I’m not eligible for maternity leave due to the state law. I’m curious if I have to put in my 2 weeks notice due to these circumstances is there anyway I’m eligible for unemployment?

    • Unfortunately, you will not be eligible since unemployment insurance is only extended to those who become unemployed due to involuntary reasons.

  28. How long does an employee have to work with a company for the company to be responsible for unemployment? Is there a time(days) requirement?

      • I work manufacturing and starting December 23-31 they are going to be rebuilding a machine leaving us with no work, could I qualify for unemployment for that time that there’s no work for me?

  29. One of our employees quit to go and work at another place. He left and worked for the other place for a month and a half. Then the other place fired him. We just got a notice that he has applied for unemployment and that we are responsible for $13,000 in unemployment insurance payments. Are we liable for this? He quit and went to work immediately for the other job and then was fired by them. Would the entity that fired him be responsible for the unemployment insurance payments?

    • Ideally, his previous employer should be paying. I am not sure how the onus falls on your company.

  30. My husband works for a contractor for fed ex. He called in sick for the first time in the 3yrs he has been with them. Ever since then he hasnt worked for going on 2weeks. He keeps calling him off due to a couple trucks being broke down. They keep telling him they will get him some work tomorrow and hasnt called him to update him. We think they are trying to get him to quite so they dont have to provide unemployment. Would he quality for unemployment even if he hasnt technically quit or got fired?

  31. I’m a 1099 “independent contractor” working for only one company and farmed out to their client. I am paid an hourly wage. Work is supplied and directed by them, travel to clients paid for by them, but work offsite and had to buy my own computer, would I be eligible for UI if I got laid off?

    • Contractors are generally not eligible to claim UI benefits since employers’ do not remit relevant taxes.

  32. I have a question about unemployment. What if someone on unemployment took a job, however after starting learned that the responsibilities and duties are dramatically different than what was explained in the interview? If the individual quits due to being mislead, could they continue to file for unemployment until they find suitable work?

    • This is a tricky situation. If you leave voluntarily, you will not be eligible.

  33. Hello. My employer has failed to make payroll by over a week for the second time in two months. I have not been fired but at some point I cannot continue to wait and see if I get paid. Currently I am on business day 7 past when payroll should have processed. At what point am I considered to be unemployed for non-payment of agreed wages on agreed schedule?

    • You will only be considered “Unemployed” if you’re officially separated from the job with proof.

  35. I am over 60 and have recently been laid off due to my section being shut down. I have worked for the company for 28 years. I have a High school diploma and work experience. I would like to go back to school to get my certification in my job field to better my chance of a higher paying job. Can I still collect unemployment while going to school? Is there specific schools I would have to apply to? I wouldn’t be able to go to school and work.

    • If you leave your job to get back to school, you may not be eligible to claim Unemployment Compensation. Having said this, there are certain listed courses and still draw UI benefits. For further details, explore the official website of the Unemployment Office or call them.

  36. my employer is writing me up fir not hitting my sales quota. I am trying but I’m probably going to be short again this month. Can I get unemployment benefits if they end up firing me for missing quota again?

    • UI benefits are only extended to those who lose their job due to involuntary reasons. Performance is considered voluntary and therefore, you will not qualify.

  38. I have been at my current job now for a year and a half as a salaried employee. When I was hired I was told I would have an assistant to help me with daily job tasks but after two months I notified my employer that the individual was not qualified or capable to do the job so I would require an assistant with experience of some sort. I was notified that they would do what they could to help me. Since then he has also remained on salary but only having to work 40 to 45 hours a week whereas I have been working as little as 60 and as much as 70 per week. I have had to be put on blood pressure medication and my dosage increased once in 2 months. I have been trying to find a differnt job for almost 2 months with no luck as I live in a small town with only seasonal work 3 months ago he hired an individual to be my assistant yet he has absolutely no experience in this field whatsoever and it just so happens that it is my employers brother. Now I am not only required to do my job as I was before but now I am having to train this individual which adds an even heavier workload. to do the job requires me to work between 12 to 15 hours a day and come in for 3 hrs of meetings on my day off. I feel as if I am trapped and don’t know what to do.

  43. I’ve worked for a retail store for 9 yrs but transfer last year to Utah and I worked for a year with them full time and I am now getting my hours cut down to 30 a week if I voluntary quit for this reason to look for a ft job can I receive unemployment ?

    • Well, if you voluntarily quit, you will not be eligible. Instead, apply for partial unemployment benefits to cover up for the hours cut.

  44. I had to undergo heart surgery and ran out of fmla, so I lost my job. I am now able to work full time but with limited physical activities. my last job of 20 years said they would hire me back but unfortunately I cant because it was mostly physical and I will have to do desk work or something like that now, but I have no experience. Will I be denied unemployment because of not being able to seek the work I am trained in? I am going back to tech school to finish up a IT class I am more then halfway done with and it will not interfere with my job looking or taking on a job, since I can switch to evening if I have to.

    • You will only be denied if you do not make the required job searches. Does not have to be in your domain I guess.

  45. My husband and I both work full time day jobs and have 2 children under the age of 10. He put in a request to work on the night shift so we have someone to watch our children during summer break but they have denied it because there are no longer any open positions for that shift (he works with a staffing agency through them so he got last pick). We make too much to qualify for childcare assistance but don’t have enough after bills to pay for daycare/nanny. One of us will have to quit and find an alternate job because there is no one to watch our children. My husband has been looking and applying for other ones but is struggling because they refuse to hire him due to his military schooling credits not providing him with an actual degree/paper. If/when he quits, will he qualify for unemployment or is it a case by case basis? (State of UT).

    • Your husband will not be eligible since unemployment insurance is only extended to those who become unemployed due to involuntary reasons.

      Unfortunately personal reasons such as yours are not considered.

  46. I am a federal employee in TN, live and work…. In the past few years I have filed in Utah, this was the last state I worked for a non-Fed employer. Last time I worked for the State of Utah was June 2013. I called today and was told I am NOT eligible b/c I hadn’t worked in Utah for the last 18 months. The last time I filed in Nov 2014, I was told I was eligble for Utah unemployment until my benefit $$ ran out. Thoughts?

    • If you do not have the required amount of employment or if your benefits from Utah has exhausted, you will not qualify.

      To be eligible, one needs to have the required duration of employment in the preceding months.

  47. I have worked for a school since August 2015. Coming to the summer the school will close for the summer. I was a paraprofessional (Teacher’s Aid). I was curious to know if I would qualify since I won’t be working during the summer since the school is out for the summer.

  48. If I didn’t qualify for FMLA and my employer termed me due to a medical leave can I apply for benefits when I’m released to work.

    • Medical issues are generally not considered. You may not qualify.

  49. Can an employee file for unemployment if they have only worked for a company for a couple of week?

    If they are granted unemployment will it impact the current employer or can it impact former employers?

  50. My employer is changing the time I am required to be to work. It is in conflict with commitments I already have in place. Am I eligible for Unemployment Compensation?
